    À Madagascar, depuis 2005, la réforme foncière reconnaît légalement l’existence d’un régime de propriété privée non titrée (PPNT) aux côtés de la propriété privée titrée. Des guichets fonciers opérant à l’échelle des communes sont habilités à délivrer des certificats fonciers, preuve légale de propriété privée, à la demande du/des propriétaires et à l’issue d’une procédure qui s’assure du consensus social local.

    Public spaces are believed to make cities more liveable, healthy and socially equal. To date, discussions about public spaces have primarily revolved around emblematic types, such as squares and parks, while little attention has been paid to cemeteries. Drawing on a review of public space scholarship and cemetery research, an analysis of strategies for cemetery development in two Scandinavian capitals, Oslo and Copenhagen, and interviews with stakeholders, this paper elaborates on the cemetery as a special type of public space.

    Le Cadre d’analyse de la gouvernance foncière (CAGF) est un outil de diagnostic permettant d’évaluer le cadre juridique, les politiques et les pratiques en matière de gestion foncière et d’utilisation des terres.

    Ce cadre conceptuel a été élaboré par la Banque mondiale depuis 2008 dans le cadre d’un partenariat avec la FAO, ONU- Habitat, le FIDA, l’IFPRI, l’Union africaine et des agences de développement bilatérales, comme outil de diagnostic permettant d’évaluer le statut de la gouvernance foncière d’un pays.

    Brazil has the fifth-largest national land area in the world and this land resource represents a critical asset for the country’s urban, agricultural, and economic development, also providing essential environmental services. Nevertheless, it has a historical lack of governance over its lands, failing to provide secure land rights and to control the extensive frauds resulting in public and private land grabs. The objective of this study is to depict evidence of these land grabs and propose a typology for analyzing them.

    At the turn of the 21st century, we can see that Brazil, the 5th largest country in the world, has been successful in developing a modern export-led agriculture distributed over large areas and also achieved a good economic performance especially through the global economic crisis after 2008. Nevertheless, the country also inherited an archaic land appropriation pattern and absence of control over its public lands – results of the lack of governance over land.

    Brazil has, on the one hand, strong institutions in various areas, improved social situation and, on the other, the rural land situation is still very precarious, with basic unresolved questions, such as for example, knowledge of what is public and private land, due to the absence of cadaster. The legislation moved forward in an attempt to link the cadasters of INCRA, the Internal Revenue Service, with information from the Registry of Real Estate with the enactment of Law No. 10,267 / 2001, creating the National Register of Rural Properties – CNIR.

    Verdade repetida insistentemente, todos sabemos que a estrutura fundiária brasileira se mantém concentrada desde sua origem. Unindo a isso o quadro de caos regulatório e legislativo no tocante da terra no Brasil, este estudo se propõe a delinear um padrão histórico de regulação da apropriação territorial até 1964 e analisar o período que se segue daí até a atualidade para mostrar que este mesmo padrão se manteve em essência, além de mostrar que esta manutenção traz consigo efeitos extremamente viciosos.
