    These Regulations, made in terms of section 45 of the Communal Land Reform Act, provide with respect to a wide variety of matters concerning communal land and communal land rights. Part I deals with (application for) customary land rights. It specifies the maximum size of land that may be held under customary land right and specifies particulars pertaining to allocation of customary land right.

    These Regulations, made in terms of section 77 read with section 46 of the Agricultural (Commercial) Land Reform, concern subletting of a farm unit. They make provision with respect to an application for consent to sublet farming unit and rent, defines size of farming unit to be sublet and the duration of a sublease, prescribe conditions on subletting farming units by sub-lessees and prescribe conditions on grazing livestock.

    Secure tenure and registered land rights are widely believed to be necessary for access to credit, well functioning land markets and economic development. As a result Namibia introduced long term leasehold rights over communal and commercial land for resettlement purposes in order to address preindependence imbalances in land holdings. The purpose is to bring the resettled beneficiaries into the mainstream of the economy, but this has not happened.

    This Notification made by the Minister of Lands and Resettlement in terms of section 39 of the Agricultural (Commercial) Land Reform Act, 1995, sets out number, location and description of farming units offered for allotment and invites, applications for the allotment of the farming units offered for allotment. Applications must be made in the manner stated in the Schedule. The Notice sets out minimum qualifications required to qualify of applicants.

    The 81 sections of the Act are divided into 8 Parts: Land Reform Advisory Commission (I); Acquisition of Agricultural Land by State for Purposes of Land Reform (II); Preferential Right of State to Purchase Agricultural Land (III); Compulsory Acquisition of Agricultural Land (IV); Alienation of Agricultural Land (V); Restriction of Acquisition of Agricultural Land by Foreign Nationals (VI); The Lands Tribunal (VII); General (VIII).Acquired land shall be redistributed to Namibian citizens who do not own land or are otherwise disadvantaged.

    This Act makes provision for the allocation of rights in land in the areas described in the First Schedule to this Act or in any area which is declared to be communal land under section 16(1)(a) of this Act ("communal land"). The Act consists of 47 sections divided into 5 Chapters.The Minister must establish Communal Land Boards to perform the functions conferred on a Board by this Act within the area for which each Board is established. Boards shall be established for a region, a part of a region or two or more regions.
