    The present Regulations are made under the Provincial Lands Act, 2016. In particular, the Regulations lay down provisions relating to Crown resource land referred to in: a) The Forest Resources Management Act; b) The Provincial Lands Act; c) The Natural Resources Act.

    This new Provincial Lands Act aims to modernize the legislative framework and provide better environmental. In particular, the Act provides for better protection for Crown land by investing the government with the ability to respond and take action when land is being misused, such as issuing immediate stop work orders. Furthermore, the framework for the Ministry of Agriculture Crown leases shall be used as security; and the time period of certain long-term leases where significant investments are possible, such as wind power development shall be increased.

    The present Act provides for a framework to protect the integrity of the land titles system in Yukon, to secure interests of property owners, and provide new economic development options. Furthermore, the Act establishes a new mechanism for registering settlement land while safeguarding aboriginal rights and title. This will create new residential and commercial development opportunities. The Land Title Office shall keep pace with the volume and complexity of modern land dealings in Yukon and provide more accessible land titles information.

    The present Regulations are made under the National Parks Act. In particular, section 3 establishes that the Minister may, for any term not exceeding 42 years and on such terms and conditions as the Minister thinks fit, grant leases of public lands, inter alia, a) in the Town of Jasper, visitor centres and resort subdivisions for the purpose of residence; b) in the Town of Jasper and visitor centres for the purposes of trade, tourism, schools, churches, hospitals and places of recreation or entertainment.

    The present Act provides the Government of the Northwest Territories with authority related to the disposition and use of land, including the disposition of subsurface minerals.     The present Regulation is made under the Act respecting the lands in the domain of the state and the Watercourses Act. Section 1 establishes that the Regulation applies to the leasing of land and other immovable rights in the waters in the domain of the State or dry land required for the building, operation and maintenance by private producers of hydroelectric power plants having a capacity of 25 MW or less and related equipment or installations. The text consists of 8 sections.

    The present Regulations are made under the Crown Minerals Act. For the purpose of the present Regulations a “mineral royalty” is a payment to the owner of mineral rights for the privilege of extracting the mineral from the ground based on a lease agreement. The royalty payment is based on a portion of earnings from production and varies depending on the type of mineral and the market conditions.

    The present Regulations are made under Mineral Resources Act, 1985 which was repealed by the Crown Minerals Act (C-50.2), but these Regulations continue in force under the Crown Minerals Act. Section 5 establishes that an application for a permit to explore for helium and associated gases may be submitted to the department, and the Minister may issue such permits in accordance with the present Regulations.
