Cette publication conjointe entre la FAO et UN-HABITAT cherche à améliorer et à mieux définir les processus, mécanismes et institutions de gouvernance foncières dans les zones rurales et urbaines. Ce document, tout en soulignant l’excellence des politiques, législations et réformes techniques foncières, en termes d’élaboration, relève toutefois un certain nombre de problèmes de mise en œuvre, en constatant des glissements, des interruptions, voire même des inversions.

Land Tenure Working Paper 19. The present paper is written as part of the overall Voluntary Guidelines consultation and development process and is a contribution to the subsequent preparation of the Gender Technical Guide. It contextualises and defines gender for the Voluntary Guidelines, discusses what governance of tenure means from a gender perspective and identifies and analyses key issues and themes. It then summarises recommendations relevant to gender before drawing some conclusions for the development process of the Voluntary Guidelines.

This co-publication of FAO and UN-HABITAT seeks to better understand and define the processes, mechanisms and institutions of governance of tenure in rural and urban areas. The paper recognises that excellent land policies, laws and technical reforms have been developed. However, in many cases their implementation has slipped, stalled or even been reversed. By adopting a governance and political economy perspective, the paper offers insights for the design of reforms and for the development of land governance tools.

En el documento se reconoce que se han realizado excelentes políticas de la tierra, leyes y reformas técnicas. La sécurité de la tenure est une condition essentielle à la gestion durable des forêts. La diversification des systèmes de tenure pourrait servir de base à l’amélioration de l’aménagement forestier et des moyens d’existence locaux, en particulier là où l’Etat ne dispose pas des moyens suffisants pour gérer les forêts. Au cours de la dernière décennie, de nombreux pays ont entamé des efforts de réforme de leurs systèmes de tenure forestière, en déléguant certains droits d’accès et de gestion aux ménages, aux sociétés privées et aux communautés.
