This Regulation lays down amendments and addenda to Regulation No. 531 of 1998 on non-divided agricultural lands. According to these new provisions, undivided agricultural lands, as identified by the competent municipal commission and certified by the chief of the immovable property registration office, can be rented by the local government to foreign and domestic individuals or legal entities.

This Law defines the legal regime of refused agricultural lands (lands which are not accepted into use or ownership by farmers). Refused lands are considered as State agricultural lands. They are transferred to the administration of the General Directorate of Forests and Pastures. The latter, through its regional directorates and in collaboration with the land distribution commissions, determines the areas of refused lands based on the data given by the municipalities and communes and certified by the immovable property offices.

The present Law supplements Law No. 7745 on the re-evaluation and re-distribution of the ex-agricultural cooperative property by introducing new provisions dealing with the social and cultural assets of the ex-agricultural cooperatives and the offices of the ex-people’s councils. They can be transferred to the commune or the municipality upon decision of the competent council. The compensation shall be paid within three years.

This Decision sets out methods for evaluating the ex-agricultural cooperatives property. Whenever the property is evaluated and distributed, or has not been distributed, the prices to be applied will be those of the evaluation period indexed at the re-evaluation time, while in cases where the property is evaluated and compensation has already been paid, the case is considered completed and no indexes shall be applied.
