    This comprehensive Agreement between Canada, British Columbia and the Tla’amin Nation is a Treaty and a Land Claims Agreement within the meaning of sections 25 and 35 of the Constitution Act, 1982. The Agreement exhaustively sets out the rights of Tla’amin First Nation, their attributes, the geographic extent of those rights, and the limitations to those rights to which the Parties have agreed.

    The present Agreement is the first combined land, resources and self-government Agreement in the Northwest Territories. Canada, the Government of the Northwest Territories(GNWT) and the Tlicho are Parties to the Agreement. The Agreement provides the Tlicho with ownership of a single block of 39,000 square kilometres of land, including subsurface resources, adjacent to or surrounding the four Tlicho communities. The Agreement also provides for self-government. A regional Tlicho Government was created with law-making authority over Tlicho Citizens in their communities and on their lands.

    The present Regulations are made under the Canada-Newfoundland Atlantic Accord Implementation Act. In particular, section 1 of the above-mentioned Regulations establish that for the purposes of paragraph (a) of the definition “offshore area” in section 2 of the afore-mentioned Act, the prescribed line of the offshore area of the province of Newfoundland and Labrador that is adjacent to the offshore area of the province of Nova Scotia is the line described in the Schedule.     The present Regulations enforce the Federal Real Property and Federal Immovables Act (S.C. 1991, c. 50). In particular, the Regulations lay down provisions relating to the leasing of oil and gas rights located on certain public lands. Section 3 establishes that subject to these Regulations, the Minister may, by way of lease, grant to any person the exclusive right to search for and take oil and gas within and under lands in the Provinces of British Columbia, Alberta, Saskatchewan, Manitoba, Ontario and Quebec. The text consists of 3 sections.

    The present Regulations enforce the Territorial Lands Act (R.S. 1985, c. T-7) and the Federal Real Property and Federal Immovable Act (S.C. 1991, c. 50). In particular the Regulations lays down provisions relating to the administration and disposition of oil and gas belonging to Her Majesty in right of Canada under all lands forming part of Canada but not within any province. Section 3 establishes that these Regulations apply only to Canada lands that are under the control, management and administration of the Minister.

In particular, the Regulations lay down provisions relating to environmental studies carried out by the Research Fund. The purpose of the Fund is to finance environmental and social studies pertaining to the manner in which, and the terms and conditions under which, exploration, development and production activities on frontier lands authorized under this Act or any other Act of Parliament should be conducted.
