    This Act provides for the establishment of Customary Land Advisory Commission. The Commission shall, among other things: (a) recommend to Cabinet suggested measures for the facilitation, encouragement and promotion of the economic use of customary land in Samoa; (b) review all laws affecting customary land in Samoa and make recommendations to Cabinet for changes to such laws where such are necessary for the facilitation, encouragement and promotion of the economic use of customary land.

    This Act provides rules for the registration of title or other interests in land and related matters and provides for the form of transfer of title in land or other interest in land such as mortgages, caveats, leases and easements.There shall continue to be a Registrar of Land who shall be the Chief Executive Officer responsible for the administration of this Act. The Registrar may delegate the Registrar’s powers and functions to the Assistant Registrar of Land.

    This Act makes provision for the subdivision of land by a registered proprietor of a freehold estate or a leasehold estate in land that is subject to the Land Titles Registration Act 2008. The subdivision of land so as to provide for units shall be effected by approval under the Survey Act 2010 of a plan, which shall be drafted in accordance with this Act. Upon the approval of a unit plan, a common property in the plan vests in the body corporate created on approval of the plan.

    These Rules of the Head of State, made under section 92(1) of the Land Titles Registration Act 2008, provide for the registration of title or other interests in land and specifically for the service of a Notice by the Registrar under section 5(1)(h) of the Act and attestation of execution of any instrument requiring attestation, which is executed in Samoa. Nothing in these regulations affects ownership of customary land held within the meaning of Article 101(2) of the Constitution or alienates customary land within the meaning of Article 102 of the Constitution.

    This Act concerns limitations applying to legal action such as actions of contract and tort; actions to recover land, registered title and rent; actions to recover money secured by a mortgage or charge or to recover proceeds of the sale of land; actions in respect of trust property or the personal estate of deceased person; and actions against the government and public authorities, etc. The Act also concerns accrual of right and relative limitations and extension of limitation periods in case of disability, acknowledgment, part payment, fraud and mistake.

    This Act provides for spatial development of Tonga and in particular, among other things, provides for the fair, orderly, economic and sustainable use, development and management of land including the protection of natural and man-made resources and the maintenance of ecological processes and genetic diversity. It establishes the National Spatial Planning Authority and appoints the Minister for Lands as the Authority. The principal function of the Authority shall be the implementation of the provisions of this Act in accordance with its objectives.

    This Act amends the Land Act (Cap. 132) in sections 30, 37, 38, 40 and 41 by repealing "convicted of an indictable offence" and replacing those words with "convicted of a criminal offence and sentenced to imprisonment for more than two years". Section 37 is further amended by adding a provision on suspension of sentence and its effects on loss of rights of inheritance. Sections 38 and 41 are further amended by repealing "conviction for an indictable offence" and replacing those words with "conviction of a criminal offence and sentenced to imprisonment for more than two years".

    This Act makes provision for the administration of estates of deceased persons and the distribution of intestate estates. The estates of deceased persons shall be administered by an administrator appointed by the Supreme Court.
