    This Act consists of 44 sections divided into 3 Parts. It regulates livestock and agricultural operations. It includes regulations for spreading manure or compost for all livestock operations in Alberta. The manure spreading regulations include requirements for manure incorporation, soil nitrogen and salinity limits, setback distances, record keeping and soil testing. The Natural Resources Conservation Board is responsible for the inspection, approval and authorization of livestock operations (for example seasonal feeding and bedding sites) and manure application.

    The present Rules are made under the Responsible Energy Development Act. In particular, the Rules establish that private surface agreements between landowners and energy companies operating on their property can now be registered with the Alberta Energy Regulator’s new Private Surface Agreements Registry (PSAR). Created as part of the Alberta Energy Regulator’s mandate to oversee energy development in the province. The Rules allow landowners to request the Regulator’s intervention, if they feel a company is not meeting a term or condition of a registered agreement.

In particular, Schedule A contains the form for land registration pursuant to section 12(3) of the afore-mentioned Act and Schedule B the form for land registration implementing section 15(1).     The present Regulation enforces the Agricultural Operation Practices Act. The Regulations lays down provisions relating to administrative procedures of the Natural Resources Conservation Board which is mandated under the afore-mentioned Act to review applications for new or expanding confined feeding operations, to monitor and enforce compliance with the Act, its Regulations and permit conditions, and to conduct hearings to review decisions.

    The present Regulation enforces the Agricultural Operation Practices Act. At the outset the Regulations contains the definition of certain terms such as, “aquifer”, “catch basin”, “common body of water”, “groundwater resource”, “liquid manure”, “private land”. Part 1 lays down provisions relating to standards applying to the owner or operator of a confined feeding operation for which an approval, registration or authorization is required under the afore-mentioned Act. Moreover, this Parts deals with manure storage and nutrient management. Part 2 concerns general administration matters.

Section 1 establishes that “existing encumbrance or mortgage” means an encumbrance or mortgage that is registered and that has or will continue to have priority over or equal priority with the mortgage to be given.     The present Code enacts the Environmental Protection and Enhancement Act. The Code lays down provisions relating to land treatment of soil containing hydrocarbons. Section 2 of Part 2 establishes that any person who constructs, operates, or reclaims a registered site, must do so in accordance with this Code of Practice, unless the site is the subject of an approval issued under section 6(3) of the Activities Designation Regulation.

    The present Act introduces some amendments to the Land Titles Act (Chapter L-4). In particular, it repeals section 3; as well as section 5 which shall read as follows: “Deputy Registrar. The Deputy Registrar may do and perform all the duties required by this Act to be done or performed by the Registrar.” Furthermore, it adds a chapter after section 43 dealing with proof of identity; and one after section 50 concerning refusal to register.

    This Regulation refers to the land measurements in certificates of title and provides for the conversion of measurements expressed in Canadian Units into the International System of Units (sect. 5). The Regulation also authorizes the Registrar to issue new certificates in both measurement systems (sect. 6).
