    The Regulations establish a scheme (the “Environmental Stewardship”) under which the Secretary of State may make grants for the management of land. Regulation 3 enables the Secretary of State to make a grant to any person who enters into, and complies with, the conditions of an environmental stewardship agreement with the Secretary of State. The agreement must require the beneficiary to carry out an activity which is conducive to a specified purpose on land in which he has an interest. It also provides for the variation of the conditions of such agreements.

    These Rules amend the Town and Country Planning (Inquiries Procedure) (Scotland) Rules 1997 and the Town and Country Planning Appeals (Determination by Appointed Person) (Inquiries Procedure) (Scotland) Rules 1997 by providing that those Rules do not apply to inquiries held in connection with the consideration of applications or appeals under the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 whose procedure is regulated by the Town and Country Planning (Appeals) (Scotland) Regulations 2008.

    These Regulations implement Directive 2011/92/EU of the European Parliament and of the Council on the assessment of the effects of certain public and private project They are concerned with the assessment of the effects of certain public and private developments on the environment and implement the EIA Directive in respect of the new two tier planning system under the Planning (Northern Ireland) Act 2011. The Regulations set out procedures and requirements for EIA to be submitted to a district council or the Department of the Environment.

    These Regulations specify the substances which are hazardous substances for the purposes of the Planning Act (Northern Ireland) 2011 and the controlled quantities of those substances. They also lay down the procedure for applications for consent and the determination of applications. Section 108 of the Act provides that the presence on, over or under land, of a hazardous substance equal to or in excess of the controlled quantity (as specified by Regulations) requires the consent of the district council.

    These Regulations amend the Town and Country Planning (Enforcement of Control) (No. 2) (Scotland) Regulations 1992 to remove provisions relating to the submission of statements in appeals against listed building enforcement notices and conservation area enforcement notices. They also make savings provisions in relation to appeals made under section 35 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997.

    The maximum rates of payments per hectare to be made by the Minister of Agriculture, Fisheries and Food pursuant to an agreement including requirements regarding agricultural practices, methods and operation made under section 18 (3) of the Agriculture Act 1986 are adjusted downwards. Also payments made pursuant to section 6, comma 1 of the principal order for agreement made before the entry into force of the principal Order are modified.

    These Regulations amend the Scottish Landfill Tax (Administration) Regulations 2015 so as to make provision for the purposes of the Scottish landfill tax in relation to weigh bridges for weighing material intended for landfill and weighing-related offences and penalties. Other provisions make minor correcting amendments.

    This Order provides that exemption certificates may be issued by Revenue Scotland to the Scottish Environment Protection Agency, Scottish local authorities and other bodies who have powers to remove illegally or improperly deposited waste. In terms of the Order, disposals of illegally deposited waste at an authorised landfill site are not chargeable to Scottish landfill tax under the Landfill Tax (Scotland) Act 2014, if made in accordance with an exemption certificate.

    This Order, made under section 13(2) and (5) of the Landfill Tax (Scotland) Act 2014, specifies the first standard rate and lower rate for Scottish landfill tax. Tax is to be calculated by reference to the weight and types of material disposed of, as provided for in section 13 of the Act.

    These Regulations further implement in Scotland the requirements of Council Directive 91/676/EEC concerning the protection of waters against pollution caused by nitrates from agricultural sources by designating the revised vulnerable zones in accordance with Article 3(4) of the Directive. Under Article 3(1) of the Directive, Member States are required to identify waters affected by pollution and waters which could be affected by pollution in accordance with the criteria set out in Annex 1 to the Directive.
