    The present Act lays down provisions relating to acquisition, sharing and protection of land. The text consists of 79 sections divided into 8 Parts as follows: Transfer and descent of land (1); Common parties contracts and conveyances (2); Partition and sale (3); Attornment clauses (4); Enforcement of mortgages and agreements for sale of land (5); Enforcement of purchase-money, security agreements (6); Mineral titles clarification (7); Miscellaneous (8).

    The present Code enacts the Environmental Protection and Enhancement Act. The Code lays down provisions relating to land treatment of soil containing hydrocarbons. Section 2 of Part 2 establishes that any person who constructs, operates, or reclaims a registered site, must do so in accordance with this Code of Practice, unless the site is the subject of an approval issued under section 6(3) of the Activities Designation Regulation.

    The present Rules are made under the Responsible Energy Development Act. In particular, the Rules establish that private surface agreements between landowners and energy companies operating on their property can now be registered with the Alberta Energy Regulator’s new Private Surface Agreements Registry (PSAR). Created as part of the Alberta Energy Regulator’s mandate to oversee energy development in the province. The Rules allow landowners to request the Regulator’s intervention, if they feel a company is not meeting a term or condition of a registered agreement.

    The present Regulation provides for the enactment of the Public Land Act. The Regulation focuses on three key themes: land management, compliance and enforcement, appeals and dispute resolution. The Regulation applies to provincial land managed by Sustainable Resource Development under the Public Lands Act. The new rules around recreation apply to vacant public land not held under a disposition that offers exclusive use. The Regulation does not apply to parks/wilderness areas (managed by Tourism, Parks and Recreation) or lands managed by Transportation or Infrastructure.

    The present Regulation enforces the Agricultural Operation Practices Act. The Regulations lays down provisions relating to administrative procedures of the Natural Resources Conservation Board which is mandated under the afore-mentioned Act to review applications for new or expanding confined feeding operations, to monitor and enforce compliance with the Act, its Regulations and permit conditions, and to conduct hearings to review decisions.

    The present Regulation enforces the Agricultural Operation Practices Act. At the outset the Regulations contains the definition of certain terms such as, “aquifer”, “catch basin”, “common body of water”, “groundwater resource”, “liquid manure”, “private land”. Part 1 lays down provisions relating to standards applying to the owner or operator of a confined feeding operation for which an approval, registration or authorization is required under the afore-mentioned Act. Moreover, this Parts deals with manure storage and nutrient management. Part 2 concerns general administration matters.
