    This article discusses how one group is contributing to critical thinking about how the Voluntary Guidelines for the Responsible Governance of Tenure of Land, Fisheries, and Forests in the Context of National Food Security (VGs) are implemented. The Future Agricultures Consortium (FAC) - an Africa-based alliance of agricultural research organizations - is both tracking implementation of the VGs and launching a study that will, among other things, investigate the multiple pressures toward the commercialization of land and the resulting impacts on land rights in Southern Africa.

    Investigates the processes and impact of commercialisation of land in Malawi – specifically the acquisition of huge tracts of communal lands by foreign companies and local elites for sugarcane production in Nkhotakota and Chikwawa districts. The main finding was that ‘land grabbing’ for large-scale commercial agriculture in these two districts negatively affected the livelihoods of the poor communal farmers.     This paper is one of three thematic case studies resulting from a set of pilot projects undertaken jointly by civil society and private business partners from 2016–2019 in five countries in sub-Saharan Africa. These pilots sought to test how private companies could collaborate with civil society organisations and other stakeholders to implement responsible agribusiness investments that recognise and respect community land rights, and to develop innovative tools and approaches that could be adopted and implemented at greater scale.

    This General Notice, made under section 6 of the Deeds Registration Act, exempts all leases, tenancy agreements or licences for the occupation of land granted by the Malawi Housing Corporation or the Capital City Development Corporation where the term granted does not exceed 364 days, from the requirement of registration as provided for in the Act.

    This Act concerns the judicature in Malawi, constitutes the High Court, provides for the establishment of subordinate courts and provides with respect to jurisdiction and proceedings of the High Court and subordinate courts. Certain provisions concern jurisdiction or procedures regarding land matters including charging or mortgaging of land and land registration. The Chief Justice may establish District Registries and appoint Deputy District Registrars for each District. Courts of Magistrates of various grades are established throughout Malawi.

    An Act to replace with amendments the law as to the registration of documents relating to land.

    The Act provides that all deeds, conveyances, wills and instruments in writing whereby any land or interest in or affecting land other than land registered in accordance with the Registered Land Act, may be affected shall subject to compulsory registration in the Deeds Registry Office. The Minister may exempt certain leases from this requirement.
