The President decrees that the plots of land and the property connected with them must be considered real estate. The real estate contracts are regulated by Civil Code in accordance with Land, Forestry, Environmental, other specific Legislative Acts and this Decree. Physical And juridical persons, that own plots of land, have the right to sell, to bequeath, to give as a gift, to mortgage, to lease, to exchange and to render them as a share to the-joint stock companies. Each landowner is provided with land certificate that must be registered into land cadastre.

The Land Code makes provision for the regulation of "land relations" and its purpose is to secure rational use and protection of land, the protection of the environment, and "the equal development of all forms of economic activity in Tajikistan" (Preamble). Other laws regulating land relations may be enacted on the basis of this Code.Land is declared to be in exclusive ownership if the State in article 2.

This Regional Law regulates relations in the sphere of organization, protection, conservation and management of protected areas with a view of conservation of unique and typical natural complexes and objects, wild fauna and wild flora, and ecological education of the population. Land areas that are integral part of protected area s under management by state and municipal environmental institutions shall not be subject to privatization. Regional protected areas can be instituted either with or without land expropriation from landowners, landlords, land tenants and lessees.

This Federal Law consists of V Sections that contain 26 Articles. Section I lays down the general provisions. This Decree establishes that the forms of Certificate of landownership can be used provisionally, till the issues of the state legal form, as a document for lifelong ownership valid for inheritance and limitless (permanent) land lease. This Decree validates the forms of Certificate of landownership, Contract of tenancy for agricultural land, Contract of temporal leasehold of agricultural land. The forms of these documents are supplied in Annexes.

The President, for the purpose of promoting effectual land tenure, decrees that the priorities of purchase of the plots of land (or the shares of them), on which are situated previously privatized edifices, have physical and juridical persons that own these edifices. The Decree establishes that the property put on sale regards plots of land (or the shares of them) that had been previously conceded to a tenant or a leaseholder on condition of permanent (limitless) tenure, lifelong ownership with the right of inheritance or of limited tenure, including rent.
