This Decree provides for the exemption from the agricultural land use tax in case of land assigned by the State to households and individuals for agricultural development, or belonging to farmer cooperatives whose land has been assigned for agricultural production, or for agricultural and forestry farmers which have been assigned lands for farming, in poor and less favoured areas.

These Rules give effect to section 175 of the Commonhold and Leasehold Reform Act 2002 which provides that permission to appeal to the Lands Tribunal from a leasehold valuation tribunal is required in all cases and that a party may not be ordered to pay costs in such appeals unless the Tribunal considers that he has "acted frivolously, vexatiously, abusively, disruptively or otherwise unreasonably in connection with the appeal" (section 175(6)). In addition minor amendments have been made to the 1996 Rules to bring them in line with the terminology of the 2002 Act.

These Rules amend the Registered Land Rules in the Third Schedule. The Third Schedule prescribes forms for purposes of the Registered Land Act. Form R.L. 7 is amended by deleting the attestation clause and substituting therefore a new clause. This form concerns transfer by personal representative of a deceased person to person entitled to become proprietor under a will or on an intestacy and the declaration of the transferees that they hold that interest as proprietors in common undivided shares.

These Regulations, made under the Native Lands Ordinance, grant powers to the Tuvalu Lands Officer to administer native estates of deceased persons in case of non-existence of a will or non-valid will. This Officer may also be appointed by will or otherwise to be the administrator in case of death of a native ordinarily resident in Tuvalu. The Regulations further define powers and duties of the administrator and specify, in the Schedule, fees for administration of estates and costs in relation with distribution of a deceased person’s estate to beneficiaries.
