    An Act to facilitate leases of settled estates.

    This Act concerns the lease of settled estates. "Settled estate" is defined in section 2 as "all immovable property and all estates or interests in any such immovable property, which are subject of any settlement". "Settlement" is defined as "any deed, agreement, will or other instrument under or by virtue of which any immovable property or any estate or any interest in any such immovable property stands limited to or in trust for any person or persons by way of succession or for a life or lives, or for a term of years determinable with the death of any person".

    Persons having acquired a just and lawful right of title in derelict lands, either by prescription or by contract or in any other manner, may apply to the High Court to order the registration of such title (sect. 3). Section 4 provides for the application for the registration of land by persons entitled to "expropriate" such land. Section 5 provides for the application to the high Court for relief by persons having a claim on derelict land.

    This Act concerns control on the use of alienated land. Whenever the President considers it necessary or expedient to do so, he or she may make Regulations for the purpose of ascertaining the nature and extent of the occupation or use of alienated land (sect. 2). The Regulations may, among other things, require owners or occupiers of alienated land to supply specified information and prescribe powers and duties of officers appointed under section 4. Such officers may be appointed by the Minister for the purpose the nature and extend of occupation and use of alienated land.

    This Act provides rules relative to the survey of land. consists of 49 sections which are divided into 9 Parts: Preliminary (I); Administration (II); Recognition and Duties of Land Surveyors (III); Original Surveys and Re-surveys (IV); Division Surveys (V); Townships (VI); Beacons and Boundaries (VII); General Plans and Diagrams (VIII); Miscellaneous (IX).At Harare a Surveyor-General's Office is established (sect. 7). A Survey Regulations Board is established under section 8. The Board may make Regulations, with approval of the Minister, prescribing matters specified in section 9.

    An Act to provide for the acquisition of ownership of things by prescription, the acquisition and extinction of servitudes by prescription and the extinction of debts by prescription; and to make provision for matters connected therewith.

    This Act shall not apply to rights and obligations governed by customary law of any person other than the State. This Act shall bind the State (sect. 3). Subject to provisions of Part II and Part V, a person shall by prescription become the owner of a thing which he has possessed openly and as if he were the owner thereof for: (a) an uninterrupted period of thirty years; or (b) a period which, together with any periods for which such thing was so possessed by his predecessors in title, constitutes an uninterrupted period of thirty years.

    This Act declares that a person occupying rural land who, but for this Act, would be subjected to any legal proceedings for an order for the recovery of possession, shall be a protected occupier of rural land for the period referred to in subsection four, if: (a) that person was occupying the land on the fixed date and is still occupying the land at the date of commencement of this Act; and (b) that person occupied such land in anticipation of being resettled by an acquiring authority on that or any other land for agricultural purposes in terms of the Land Acquisition Act [Chapter 20:10]; a

    An Act to alter and amend the boundaries of certain lands.

    This Act concerns the ownership of so-called “inner banks”. Section 2 makes provision for the definition of boundaries in original grants of land made by the British South Africa Company. The boundary shall be the centre of the said river or stream. Any subsequent transfer of land the boundary of which is so described under one undivided transfer shall be deemed to have conveyed the land up to the centre of the river or stream mentioned as a boundary in the original grant or diagram, and to have vested the ownership of the land as thus bounded in the holder of the title to the land.

    This Act is repealed by Section 8 of the Land Acquisition Amendment Act 1 of 2004. Notwithstanding any condition contained in any agreement of lease, or sale or other disposition between the Hippo Valley Estates Limited or its successors in title and any person in respect of land transferred to it or under its control in terms of the agreement set out in the Schedule to the repealed Act, or contained in any title deed in respect of such land, the State may, in terms of the principal Act, compulsorily acquire as agricultural land required for resettlement purposes any such land.

Any person who has capacity pursuant to this Act to make a will may therein: (a) make provision for the transfer, disposal or disposition of the whole or any part of his estate; and (b) make provision for the custody or guardianship after his or her death of any of his minor children; and (c) make any other lawful provision, disposition or direction, whether in respect of his or her own or any other property or in respect of any other matter.
