    These Regulations provide for the incorporation into Irish law, in respect of relevant development of Directive 85/337/EEC on the assessment of the effects of certain public and private projects on the environment. The Regulations modify the provisions of the Local Government (Planning and Development) Acts, 1963 to 1983 so as to provide a framework for the application of Environmental Impact Assessment (EIA) to the planning control procedures under those Acts, and for the application of EIA to relevant development by local authorities.

    These Regulations amend provisions relating to environment impact assessment. The amendments restate provisions relating to the information to be contained in an environmental impact statement and exemptions from the requirement to prepare an environmental impact statement. The Regulations also extend the provisions concerning the furnishing of additional information relating to an environmental impact assessment.

    The purpose of these Regulations is implement provisions of Directive 97/11/EC relating to environmental impact assessment in Ireland. These Regulations contain amendments to the European Communities (Environmental Impact Assessment) Regulations, 1989 to 1998, and to provisions relating to environmental impact assessment in Local Government (Planning and Development) Acts, 1963 to 1998, and a number of other Acts.

    The amendments of this Act to the Fisheries Acts, 1959 to 1997, the Foreshore Act, 1933, and the Fishery Harbour Centres Act, 1968 concern the granting of a foreshore licence for aquaculture purposes under the Act of 1933, or a fish culture licence under section 15 of Fisheries Acts, 1959 to 1997. These licences shall be deemed to an aquaculture licence granted under the Fisheries (Amendment) Act of 1997. Specific conditions are set out for the procedures of granting a foreshore licence deemed to be an aquaculture licence under the 1997 Act.

    An Act to make provision for the granting of leases and licences in respect of foreshore belonging to Saorstát Eireann and to amend generally the law relating to foreshore and the seashore.

    Section 2 allows the Minister to grant leases on the foreshore in the public interest. "Foreshore" means the bed and shore, below the line of high water of ordinary or medium tides, of the sea and of every tidal river and tidal estuary and of every channel, creek and bay of the sea or of any such river or estuary. Every lease shall contain prescribed clauses or covenants as listed in section 2.

    These Regulations set out a number of procedural requirements in relation to the preparation of regional planning guidelines by regional authorities. These procedural requirements supplement those already set out in the Planning and Development Act 2000. The Regulations also specify the National Spatial Strategy as being of relevance to the determination of strategic planning policies. This means that regional authorities must take account of the National Spatial Strategy when preparing and making regional planning guidelines.

    The purpose of these Regulations is to facilitate compliance with the European Court of Justice ruling of 21 September 1999 (Case C-392/96) that the EIA thresholds adopted by Ireland in relation to initial afforestation and peat extraction exceeded the discretion available to Ireland under Directive 85/337/EEC on Environmental Impact Assessment in that they did not take account of the nature, location or cumulative effect of projects below these thresholds. The threshold for mandatory EIA in relation to these activities is reduced.

    Part 1 of the Second Schedule to the Local Government (Planning and Development) Regulations, 1994 (S.I. No. 86 of 1994) is hereby amended by the substitution of the following for the part of the said Schedule relating to the development within the curtilage of a dwelling house. changes made relate to Class 1 of Part 1 of the Second Schedule (domestic extensions).

    These Regulations carry into effect in Ireland Directive 2001/42/EC on the assessment of the effects of certain plans and programmes on the environment insofar as the Directive relates to plans and programmes in all of the sectors listed in article 3(2) of the Directive except land-use planning. The Regulations concern the consideration of the likely significant effects on the environment of such plans and programmes.

    These Regulations carry into effect in Ireland Directive 2001/42/EC of 27 June 2001 on the assessment of the effects of certain plans and programmes on the environment insofar as the Directive relates to land-use planning. The Regulations concern the consideration of the likely significant effects on the environment of specified public development plans. The Regulations prescribe procedures and contents of environmental reporting, monitoring and assessment in relation to each type of plan. A consideration of transboundary environmental effects in specified cases is also made.
