    An Act to amend and extend the Planning and Development Act 2000, to amend the Transport (Railway Infrastructure) Act 2001, and to provide for related matters.

    This Act principally amends the Planning and Development Act, 2000 so as to, among other things, change the list of legal acts of the European Union given effect to by the principal Act and to provide for a wide variety of environmental protection measures in relation with planning and development including protection of habitats, landscape, water resources and biodiversity. The Planning and Development Act, 2000 and the Waste Management Act, 1996 are amended in relation with protection of European sites as defined by the principal Act.

    These Regulations prescribe bodies for consultation and submission of observations to the Minister for the Environment, Community and Local Government in respect of an application for a foreshore lease, licence or permission as may be issued under the Foreshore Act. They also prescribe a statutory time limit for such consultations.

    These Regulations designate a coastal area as a Special Protection Area in accordance with Article 4 of Directive 2009/147/EC of the European Parliament and of the Council on the Conservation of Wild Birds. The purpose is to ensure survival and reproduction of all species of birds to which Article 4 relates and in particular those listed in Schedule 3 to these Regulations. Schedule 4 lists activities that require the consent of the Minister and may cause disturbance or damage to birds protected under Schedule 3.

    These Regulations provide for the direct application by state authorities to An Bord Pleanála (National Planning Board) for approval for works or development where the works or development are urgently required in order to preserve, protect or improve the quality of the environment or protect human health, in compliance with EU Directives.
