The present Act makes arrangements relating to lands in Forest Areas. Such lands shall be sold by the appropriate authority to peasants who have "settled down there and who have been cultivating the lands for at least one year past..." (art. 4(1)). Land left over after sale and distribution as described above shall be sold or distributed in the prescribed manner. Further provisions concern the registration of lands, the modalities for the payment of the price of the land by the allottee and enforcement measures.

The Ministry of Finance now issues guidelines for provision of credits from the State for programmes and projects for use of bare land, degraded hills, forests, alluvial flats, and water bodies within the framework of Decision 327-CT and according to duly approved annual plans: Funds from the State budget are to be provided in the form of credits for basic construction and for non-commercial economic purposes for programmes and projects for the use of bare land, degraded hills, forests, riverine and coastal alluvial flats, and water bodies.

This Decree provides for the assignment of forestry land by the State to organizations, households and individuals for "stable and long-term" use in the form of land assignment without land use levy or lease of forestry land (art. 1). Forestry land is allocated or leased to specified subjects whose main source of income is agriculture, aquaculture of the winning of salt or various specified organizations. No levies shall be charged. Forestry land includes: national parks, nature conservation forests, and various kinds of protection forests (art. 3).

Chapter one of this Law contains definitions of terms therein employed, such as: forest, forest bushes, desert shrubs, forest cover and regions, range, planted rangeland, logs and saplings. The newly instituted Survey and Demarcation Division shall conduct the survey and definiton of boundaries of the so called reserved Forests of Bhutan and shall widely spread information about the forest areas included under this provision, in order to ascertain eventual claims of rights on forests and their products, land and water courses or grazing and pasture rights. The involved land shall be excluded from the reserved forest areas or expropriated or acquired.

The present Regulation provides guidelines to the Ministry of Environment and Forestry on planning afforestation activities: (i) Preparation of afforestation projects; (ii) Selection of areas for afforestation; (iii) Organizing forest - social community relations; and (iv) Preparation of annual programs and location distribution tables. One year prior to afforestation, all trees and shrubs that are classified as non-economic will be cleared from the area.
