    This Order modifies section 7(1) of the Land Reform (Scotland) Act 2003. The Act provides that access rights are not exercisable over the categories of land specified in section 6. This does not prevent or restrict the exercise of access rights over any land which is a core path. This amendments makes exceptions to this rule for reasons of control of an outbreak of animal disease, or where land has been included in an Order under section 11 of the Act.

    This Act concerns national parks and other protected areas and access to the countryside. The provisions of this Part of this Act shall have effect for the purpose of conserving and enhancing the natural beauty, wildlife and cultural heritage of the protected areas. The Act provides for establishment, management and conservation of national parks and nature reserves and for compulsory acquisition of land for purposes of this Act. The Act also concerns public rights of way and access to open country.

    This Act provides a legal framework that will promote and encourage community empowerment and participation. It creates new rights for community bodies and places new duties on public authorities. The Act amends the Land Reform (Scotland) Act 2003, extending the community right to buy to all of Scotland, urban and rural, and improving procedures. It also introduces a new provision for community bodies to purchase land which is abandoned, neglected or causing harm to the environmental wellbeing of the community, where the owner is not willing to sell that land.

    These Regulations make provision in relation to bringing into force sections 83 (core path plans) and 84 (access rights: service of court applications) of the Land Reform (Scotland) Act 2016. It also contains transitional provisions regarding "core path plans" as provided for by the Land Reform (Scotland) Act 2003. The effect of this is that anything done under the old law before 31st December 2016 will have effect as if it had been done under the new law.
