Cette loi porte organisation de la propriété foncière. A cette fin elle institue un service dit de la conservation foncière, chargé d'assurer aux titulaires la garantie des rôles réels qu'ils possèdent sur ces immeubles, et ce au moyen de l'immatriculation de tous les immeubles aux livres fonciers et la publication sur les livres fonciers de tous les droits réels qui s'y rapportent. L'immatriculation est obligatoire et définitive. Sont considérés immeubles par l'objet auquel ils s'appliquent: les droits réels immobiliers et les actions qui tendent à revendiquer un immeuble.

Persons having acquired a just and lawful right of title in derelict lands, either by prescription or by contract or in any other manner, may apply to the High Court to order the registration of such title (sect. 3). Section 4 provides for the application for the registration of land by persons entitled to "expropriate" such land. Section 5 provides for the application to the high Court for relief by persons having a claim on derelict land.

This Proclamation makes provision for the registration of land and other immovable property. It provides for the establishment of a Cadastral Office, for the registration of all land, rights over land and duties that emanate from such rights, and the transfer of property through sales, donation, succession or other manner. The registration system shall use the application forms and certificate pursuant to Legal Notice No. 31/1997. On the basis of the abovementioned documentation, the Cadastral Office shall keep a map or plan that clearly shows parcel features and boundaries.

Ce décret porte dispositions du Livre II, Titre III du Code civil, relatives à la transmission de la propriété immobilière. La propriété privée du sol et des immeubles n'est légalement établie que par certificat d'enregistrement et les mutations ne s'opèrent que par un nouveau certificat d'enregistrement. Doit également être inscrit au certificat tout contrat de location pour une durée supérieure à 9 ans.

En vertu de ce décret du 1886, les droits privés déjà existants ou qui sont à acquérir doivent, pour être légalement reconnus, être enregistrés par le conservateur des titres fonciers. Toutefois, le décret prévoit que les terres occupés par des populations indigènes, sous l'autorité de leurs chefs, continuent d'être régies par les coutumes et les usages locaux. Sont interdits tous actes ou conventions qui tendraient à expulser les indigènes des territoires qu'ils occupent ou à les priver, directement ou indirectement, de leur liberté ou de leurs moyens d'existence.
