This synthesis of our findings from an investigation of tenure risk in East, West, and Southern Africa, shows that a majority of tenure disputes are caused by the displacement of local peoples, indicating that companies and investors are not doing enough to understand competing claims to the land they acquire or lease. This failure in diligence is particularly noteworthy given that a majority of the disputes analyzed had materially significant impacts: indeed, a higher proportion of projects in Africa are financially impacted by tenure dispute than any other region in the world.

Land Tenure Working Paper 21. This paper draws on proceedings of a meeting held to discuss the impact of growing private sector investments in land, fisheries and forests. This meeting, aimed at the private sector, took place at FAO headquarters on 28 February and 1 March 2011. The purpose of this paper is to provide a record of the discussion from the private sector perspective. The first section provides the context which led to the workshop concept.

Con estas Directrices se busca aportar beneficios a los individuos en todos los países, aunque se hace hincapié en las personas vulnerables y marginadas. Las Directrices sirven como texto de referencia en el que se estipulan principios y normas internacionalmente aceptados para las prácticas responsables de la gobernanza de la tenencia. Las Directrices constituyen un marco que los Estados pueden utilizar a la hora de elaborar sus propias estrategias, políticas, legislación, programas y actividades.

Dans le cadre de l'initiative de la FAO sur les Directives Volontaires sur la gouvernance responsable de la tenure des terres et des autres ressources naturelles, une réunion de consultation régionale était organisée à Ouagadougou, Burkina Faso les 23-25 juin 2010. La réunion était une occasion d'échanger des expériences et de discuter des questions et des actions de gouvernance foncière à être intégrées dans les Directives Volontaires. Cette évaluation régionale synthétise les résultats de la réunion de consultation.

The effect of prime-age adult death and its consequences on access to land for the survivors has not been fully explored nor incorporated into policy regardless the fact that high adult mortality is now the lived reality in countries affected by HIV/AIDS, particularly in Africa. This paper explores the gendered relationships between adult death due to HIV/AIDS and changes in land rights for the survivors particularly widows. In many African societies, women have traditionally accessed land through marriage.

Ce document décrit le point de vue des parties prenantes sur le développement des Directives Volontaires pour la gouvernance foncière. Ces Directives représentent le plus grand «terrain d’entente» sur la gouvernance foncière qui a été trouvé à ce jour dans un forum mondial. Ce consensus a été construit sur la base de (développé à travers des) négociations intergouvernementales avec la participation de incluant la société civile, du le secteur privé et des institutions académiques et de recherche.

Esta publicación compartida por la FAO y Naciones Unidas-Hábitat trata de comprender y definir mejor los procesos, los mecanismos y las instituciones de la gobernanza de la tenencia en áreas rurales y urbanas. En el documento se reconoce que se han realizado excelentes políticas de la tierra, leyes y reformas técnicas. The study aims to clarify the various issues regarding land security of poor and other marginalized groups in Malian rural areas. It looks into questions relating to how poor and vulnerable groups obtain access to land and natural resources, and what factors cause their exclusion. It analyzes existing methods for formalizing land rights and land transactions and their impacts on the poor. Specific attention is given to the practical organization of the procedures for formalization and recording land rights.
