   Administration of Small Estates Act (Cap. 9:06).

   An Act to make special provision for the grant of letters of administration and probate of wills of small estates and for the remission of certain duties and fees in connection therewith.

   This Act provides for the administration of small estates in case of an owner dying intestate or with a will leaving a small estate. "Small estates" means all property, real and personal, of a deceased person which does not exceed a specified value. Persons specified in section 3 may apply to the Registrar to be appointed as administrator. Section 4 provides for nomination by a Judge in case of probate of will of a deceased person. Duties and powers of the Registrar are set out in sections 5 and 6.

   This Act provides rules relative to the conveyancing of rights in land such as property, easements, lease and mortgages. It regulates, among other things, the contents of a deed and covenants and power of attorney.

   This Act provides for the establishment of the Development and Planning Corporation, defines powers and functions of the Corporation and makes provisions in relation with tax incentives for development.The Corporation shall be responsible for physical planning in Dominica. It shall have the power to carry out or secure the laying out and development of designated areas.The Corporation shall have also various powers in respect of dealings in land such as acquisition, sale or lease.

   This Act concerns the validity of claims of prescription which may be lawfully made at common law or by custom to any way or other easement or to any watercourse or to the use of any water, to be enjoyed or derived upon, over or from any land or water. The Act, among other things, sets out criteria for the establishment of the period after which a claim shall be held valid.

   This Act provides rules relative to the possibility of discharge of debt incurred by heirs of a real estate deriving from mortgage or any other equitable charge. The Act also makes provision with respect of mortgagees in recovering debt and duties of heirs or testators or intestate as regarding debts relating to the estate.

   This Act provides with respect to legal actions relating to recovery of rent or land and it places restrictions on the making of entries, distress, action or suit for the reasons as specified in the Act.Legal actions concern the recovery of land or rent, assurances made by tenants in tail of any land, rights of mortgagees and recovery of sums of money secured by any judgement, mortgage or lien. Limitation of action can arise from disability, infancy or unsoundness of mind, absence of persons, etc. Limits in time are specified for various legal actions.

    This Act makes provision with respect to the recovery of rent due by a tenant to a landlord. Distress in case of arrears for tenancy includes the seizure of animals and crops. The Act also concerns the protection of interests of a landlord against illegal action by the tenant.
