    The management of conflict over land and natural resources is a very broad issue and there is a growing literature on techniques that have potential for use in this field. At the moment, the Land Tenure Service of FAO’s Rural Development Division is working towards achieving a deeper understanding of the current methods and practices in land conflict management and is gathering cases from all over the world to ascertain the techniques used and the results achieved.     The present paper – the third in the HIV/AIDS Programme Working Paper Series – is based on field research conducted by two grassroots organizations – CINDI-Kitwe in Zambia and GROOTS Kenya in Kenya to map out and document cases of property grabbing from children, in particular those who became orphans due to AIDS. It is intended to explore methods which grassroots organizations use or can use to document their work.

    Safeguarding property rights of vulnerable people is an important policy issue, not least in the quest for poverty reduction in poor societies. This issue has become urgent due to recent developments, including the AIDS epidemic, globalization, climate change and other similar social and natural forces. This study sets out to assess the extent to which property and inheritance rights of widows and orphans are violated or protected in the context of HIV and AIDS in two rural communities in Tanzania.

    This report is based on the proceedings of the Technical Consultation on Gender, Property Rights and Livelihoods in the Era of AIDS, organized by FAO in November 2008.     The articles in this volume supplement FAO Land Tenure Studies 10, Compulsory acquisition of land and compensation. The latter publication explains what compulsory acquisition and compensation are and what constitutes good practice in this area. This current volumes introductory article provides an overview of these issues. The issue of compulsory acquisition from a human rights perspective is also addressed here as are the concepts of market value, compensation value and just terms compensation.

Thus, even though most have assets of some kind, they have no way to document their possessions because they lack formal access to legally recognized tools such as deeds, contracts and permits.

    This paper identifies the key issues of land tenure security for the rural poor, vulnerable and marginalized in the East African countries of Kenya, Tanzania and Uganda. The report finds that most of these issues are common across the three countries, both in terms of the challenges that the communities face and imperatives that inform policy interventions and responses.

The Commission on Legal Empowerment of the Poor (CLEP) is the first global anti-poverty initiative focusing on the link between exclusion, poverty and law, looking for practical solutions to the challenges of poverty.
