The purpose of this Act is to regulate provisions regarding transfer of lands to individuals in order to make efficient use of water and fertile soil, as well as leading the country to self-sufficiency. In particular, it should be noted that rights of the people on fruitful lands should be respected. Exploitation of the natural woods and forests are exclusive rights of the Government. The Government may assign abandoned lands to individuals for agricultural purpose. Indigenous people and persons with knowledge in agriculture are considered as a priority.

The purpose of this Act is to regulate general principles governing the limits of ownership of lands by individuals in the country. In particular, no one may own more than a certain amount of land in the whole country. Any land in excess shall be seized by the Government and redistributed. Fruit and tea gardens, as well as agricultural land are exempt from this limitation. Abandoned land, wasteland and land exceeding the maximum permitted, are considered eligible for division and redistribution. According to the Act, farmers are considered as priority in land redistribution.

This Law, which consists of 8 articles, is codified to amend and add a number of supplementary provisions to the Law of 21 June 1995 on Preserving the Land Use of Farms and Gardens. The main rules of the afore-mentioned Law on Preserving the Land Use of Farms and Gardens remain unchanged and some detailed regulations have been amended or added by this Law. In particular, the Law adds 6 articles (articles 7 to 12) to the said Law. Accordingly, providing that any public service and infrastructure in farms and gardens may be allowed only after official authorization for land use change.

The Regulation prohibits cutting trees in public areas, gardens and parks within the boundaries of the cities. After the Revolution, in 1979, the Government authorized farmers to temporarily farm in some abandoned lands. The Regulation, which consists of 31 articles, aims to transfer the ownership of these lands to the farmers in return of monthly installment of the land’s actual value. Accordingly, the Regulation provides details of the process to grant ownership. The eligible farmers to receive ownership, as well as the actual price of each land, should be determined by a specified committee.

According to the Act, any construction in the determined limit of the coastal zone and inland is prohibited unless for necessary public facilities. Any trespassing to these limits or any destruction of their current situation may lead to persecution by authorities.

The Act states that the Ministry of Housing and Urban Development shall decrease urban development to the farms and gardens surrounding the cities and minimize changes in land use of farms and gardens inside urban areas.
