    This Order allows for the creation of a nationally significant infrastructure project and associated development described in Schedule 1 and a corresponding marine habitat. There shall be put in place for the affected coastal area a compensation environmental management and monitoring plan and other environmental compensatory measures.

    These Regulations relate to agreements between access authorities and owners and occupiers of land with respect to access land as provided for by the Countryside and Rights of Way Act 2000 and the Marine Coastal Access Act 2009. Access may be required by authorities to carry out works. The Regulations provide for the period within which, and the manner in which, appeals under section 38(1) of the 2000 Act and paragraph 4 of Schedule 20 to the 2009 Act are to be brought, and also make provision for the advertising of those appeals and for the appeal procedures.

    These Regulations amend for England the Access to the Countryside (Exclusions and Restrictions) (England) Regulations 2003 in relation to access to land which is coastal margin. They amend provisions relating to: directions under sections 24 or 25 of the Countryside and Rights of Way Act 2000; consultation on proposals for long-term exclusions or restrictions; and the right to request site inspection as part of an appeal.

    In respect to Wales, these Regulations provide in relation to those further areas designated as nitrate vulnerable zones by virtue of the Protection of Water Against Agricultural Nitrate Pollution (Amendment) (Wales) Regulations 2002 that the date for the multiplier of 210 kg set down in paragraph 9(2)(b)(i) of the Schedule shall be extended to 19 December 2006. In relation to those areas designated as nitrate vulnerable zones prior to the 2002 Regulations the relevant date remains the 19 December 2002.

    By establishing an action programme for nitrate vulnerable zones these Regulation implement, as regards England and Wales, the requirement in this respect as laid down in article 5 of Council Directive 91/676/EC concerning the protection of waters against pollution by nitrates from agricultural sources. Regulation 3 requires an occupier of a farm or livestock unit comprising all or part of a nitrate vulnerable zone to ensure that the action programme set out in the Schedule is implemented.     These Regulations amend the principal Regulations so as to: (a) correct the definition of a nitrate vulnerable zone (reg. 2(3)(b)); (b) refer to an "occupier" in regulations 4 and 5 rather than a "person" (reg. 2(4) and (5)(a)); (c) improve the drafting of paragraph 5 of the Schedule (regulation 2(6)); and (d) amend the requirements set out at paragraphs 10(1) and 10(2) of the Schedule (reg. 2(6)).

    These Regulations amend the Action Programme for Nitrate Vulnerable Zones (Scotland) Regulations 2008 to correct minor errors in regulation 9 so that that regulation applies to the storage of livestock manure other than slurry.

    These Regulations amend the Action Programme for Nitrate Vulnerable Zones (Scotland) Regulations 2008 so as to implement Commission Decision 2009/431/EC granting derogation to England, Scotland and Wales pursuant to Council Directive 91/676/EEC concerning the protection of waters against pollution caused by nitrates from agricultural sources.The Regulations provide for a derogation from the annual farm limit of nitrogen in livestock manure which may be obtained from the Scottish Ministers by an occupier of any grassland farm within a nitrate vulnerable zone.
