    These Regulations amend the Common Agricultural Policy Single Payment Scheme (Set-aside) (Wales) Regulations 2005 in relation to the good agricultural and environmental conditions that apply to land set aside under the Single Payment Scheme for farmers enacted by force of Community legislation. The conditions and exemptions concern green cover, the setting aside of land for the control of weeds, use of pesticides and grazing.

    These Regulations make provision for the selection, designation, registration and notification of sites to be protected under the Council Directive 92/43/EEC on the conservation of natural habitats and of wild fauna and flora. These Regulations also implement aspects of the Marine and Coastal Access Act 2009. They make provision in respect of European sites for: (a) control of damaging operations caused by human activity; (b) special nature conservation orders and restoration orders; (c) byelaws of the appropriate nature conservation body; and (d) compulsory acquisition.

    This Order is made under section 18 of the Agriculture Act 1986 which gives the Minister of Agriculture, Fisheries and Food the power to designate an area of England as an environmentally sensitive area. In such area particular agricultural methods shall be adopted so as to conserve, protect or enhance environmental features in that area. For this purpose the Minister may enter into a management agreement with any person having an interest in agricultural land in any designated area.

    These Regulations designate a coastal area consisting of land and marine waters as a Special Protection Area in accordance with Article 4 of Directive 2009/147/EC of the European Parliament and of the Council on the Conservation of Wild Birds. The purpose is to ensure protection from disturbance, capture and damage to nests and eggs under Article 5 of the Directive for all species of birds, not just the birds listed on Schedule 3 (with the exception of those birds covered under Articles 7 for hunting and 9, where derogations are listed).

    This Order modifies section 7(1) of the Land Reform (Scotland) Act 2003. The Act provides that access rights are not exercisable over the categories of land specified in section 6. This does not prevent or restrict the exercise of access rights over any land which is a core path. This amendments makes exceptions to this rule for reasons of control of an outbreak of animal disease, or where land has been included in an Order under section 11 of the Act.
