    This Order makes amendments to the Agricultural Holdings (Scotland) Act 2003 so as to make it compatible with a specified human right. It inserts a new section (section 72A) into the 2003 Act. That section provides that section 73 applies to a tenancy continuing to have effect by virtue of section 72(6) unless the tenancy is a relevant tenancy

    These Regulations apply to certain public agricultural land, namely to land that belongs to the Government and which is mainly let for the growing of crops, flowers, fruit-trees or vines and for cognate agricultural purposes. These provisions regulate the transfer and lease of such agricultural land.

    These Regulations make provision on leases relative to agricultural lands. The Registrar of the Superior Courts is designated to be the Registrar of the Board in regard to any proceedings which concern land situated in the Island of Malta. With respect to proceedings concerning land situated in the Island of Gozo or Comino, however, the Registrar of the Court of Magistrates of Gozo shall have such competence. Regulation 4 defines the content of applications to the Board.

    These Regulations prescribe terms, set out in Schedule 1, as to the maintenance, repair and insurance of fixed equipment which are deemed to be incorporated in every contract of tenancy of an agricultural holding except where they would impose on one of the parties to a written agreement a liability which under the agreement is imposed on the other. They divides between the landlord and the tenant of a holding the responsibility for maintaining, repairing and insuring fixed equipment, and imposes upon each party certain specific liabilities in regard to those matters.

    These Regulations introduce a new prescribed form for a notice under section 21(1) or (4) of the Housing Act 1988 informing a tenant that the landlord intends to seek recovery of possession of a property let on an assured shorthold tenancy (“a section 21 notice”) and new restrictions on the use of the “no fault” eviction procedure for assured shorthold tenancies where a landlord has not complied with certain obligations.

    These Regulations amend the Assured Tenancies and Agricultural Occupancies (Forms) (England) Regulations 2015 by substituting new Forms 3, 4 and 5 for the equivalent forms prescribed in the principal Regulations. Amendments have also been made to regulation 3A (Review) of the principal Regulations which require the Secretary of State to review the operation and effect of the requirement to use the prescribed forms inserted by these Regulations (Forms Nos 3, 4 and 5) and publish a report.
