    This Act amends provisions of the principal Act with the scope of bringing about improvement of the offer of arable land including land suitable for fast growing timber forestry. Provisions deal with revision of lease rates, alienation of land within 10 years after acquisition with preferential rights by former leaseholders, public lease, special short-term lease contracts, protection of leaseholders against strict terms imposed by landlords and other connected matters.     Section 11 forms part of first paragraph (entitled “Hereditary lease”) which forms part of the third Chapter entitled “Granting of rights in respect of lands of the domain”. Section 11 regulates the use of plants and trees present on the public lands tenured in long-term lease. The tenant has the free right of exploitation or other use of trees and plants if not otherwise expressly provided in the hereditary lease order and subject to payment to the President of charges for the logging of valuable timber species.

    This Decree specifies circumstances in which the Office for the Administration of Agricultural Land may allocate agricultural land in leasehold pursuant to article 57, first comma, of the Agricultural Land Transaction Act. The circumstances include succession and expansion of the farm.

    Decree regulating the rent for the lease of agricultural land. The Decree seeks to re-establish a balance between interests of the lessee and those of the lessor. Owners of agricultural land who give the land in lease may obtain a net gain of 2 percent of the free market value of land free of lease excluded costs which are to be bared by the landowner. Article 1 defines "free market value" as the price for the land in agricultural use but free of lease which results from reasonable negotiation between buyer and seller on the market.

    This Ordinance of the Governor of Sint Maarten provides rules relative to matters of inheritance. It replaces completely book 4 and title 3 of Book 7 of the Civil Code. It concerns inheritance based on will an intestate. Various provisions concern rights in land, including usufruct and lease of land. Donation shall be effected by notarial deed.

    The land tenant shall be allowed to freely use of plants and trees that are planted by others, as far as such use is not excluded in the allocation order and subject to payment imposed by laws for the logging for other purposes than own use. If on the land timber is processed or balata or other forest products are exploited, except for own use, the tenant shall be subject to payment of such levies and charges as are applicable to such activities on land of the domain, except in case of exemption pursuant to a concession.
