Ce document prsente une synthse des travaux de la runion et les diffrents articles qui ont t produits par les participants, les partenaires du rseau et les collgues de la FAO, loccasion de cette rencontre.

The present paper – the third in the HIV/AIDS Programme Working Paper Series – is based on field research conducted by two grassroots organizations – CINDI-Kitwe in Zambia and GROOTS Kenya in Kenya to map out and document cases of property grabbing from children, in particular those who became orphans due to AIDS. It is intended to explore methods which grassroots organizations use or can use to document their work.

This paper focuses on legal and institutional aspects of children’s property and inheritance rights in Southern and East Africa. Chapter 2 discusses violations of children’s property and inheritance rights and discusses how the spread of HIV/AIDS has contributed to the violations. Chapter 3 assesses several norms of customary law that aim to protect children’s property and inheritance rights as well as the current practices of customary law that—in the context of the HIV/AIDS pandemic—serve to complicate and limit children’s ability to maintain their rights.

Le résultat est une analyse qui identifie les principaux facteurs juridiques et certains facteurs non juridiques ayant une incidence sur l’existence et l’exercice des droits des femmes liés à l’agriculture.

Sus roles difieren según las regiones, aunque siempre tienen un menor acceso que los hombres a los recursos y oportunidades que necesitan para ser más productivas. Si se incrementara el acceso de las mujeres a la tierra, la ganadería, la educación, los servicios financieros, la extensión, la tecnología y el empleo rural, aumentaría su productividad así como la producción agrícola, la seguridad alimentaria, el crecimiento económico y el bienestar social.

Esta publicación compartida por la FAO y Naciones Unidas-Hábitat trata de comprender y definir mejor los procesos, los mecanismos y las instituciones de la gobernanza de la tenencia en áreas rurales y urbanas. En el documento se reconoce que se han realizado excelentes políticas de la tierra, leyes y reformas técnicas. Sin embargo, su implementación en muchos casos ha sido errónea, ha sufrido retrasos o, incluso, se ha invertido.
