    This Order amends Part 1 of Schedule 8 to the Agricultural Holdings Act 1986 as it applies to England. Section 64 of the Agricultural Holdings Act 1986 entitles the tenant of an agricultural holding, on termination of the tenancy and quitting of the holding, to compensation from the landlord for an improvement specified in Part 1 of Schedule 8 which the tenant has carried out on the holding.

    These Regulations prescribe the procedure to be followed by a crofting community body when it wishes to apply to Scottish Ministers for a grant under section 90 of the Land Reform (Scotland) Act 2003. Such a grant may be applied for when a crofting community body is liable to pay compensation under section 89 of the Act to any person, including the owner, or former owner of land or sporting interests, and that body has been unable to obtain enough money to pay, or to pay in full, the compensation.

    This Order contains a provision which is supplemental to the High Hedges (Scotland) Act 2013. It provides that section 12(1) of the Land Registration (Scotland) Act 1979 (indemnity in respect of loss) does not apply in respect of any loss arising in consequence of an inaccuracy in a notice of liability for expenses incurred by the authority for action taken by them where there has been a failure to comply with a high hedge notice or a notice of discharge registered by the Keeper of the Registers of Scotland.

    These Regulations make amendments consequential to the coming into force of the Localism Act 2011. Schedule 2 to this Order makes amendments consequential to the provisions of section 232 of the Localism Act 2011, which amends Parts II and III of the Land Compensation Act 1961 in relation to certificates of appropriate alternative development and assessment of compensation. Schedule 3 makes an amendment to Schedule 8 to thee Planning and Compulsory Purchase Act 2004, which makes transitional provision in relation to old plans and policies.

    These Regulations concern compensation in the case that a planning permission granted by a local planning authority is subsequently revoked or modified, or planning permission granted by a development order or a local development order is withdrawn. The Regulations make amendments, in respect of Wales, to section 108 of the Town and Country Planning Act 1990, regarding conditions for entitlement to compensation.

    These Regulations make provision about how voluntary trust deeds entered into by debtors for the benefit of their creditors become protected from action by creditors. They also provide with respect to the consequences of a trust deed being granted that status, the rights of creditors, the discharge of the debtor and trustee from the trust deed, the administration of trust deeds, the conditions which must be met for a debtor to be discharged of debts and obligations under the protected trust deed and appeals against decisions of the Accountant in Bankruptcy.

    These Regulations amend: (a) the Radioactive Contaminated Land (Modification of Enactments) (England) Regulations 2006 so as to apply the modifications those Regulations make to Part 2A of the Environmental Protection Act 1990 to all radioactivity; and (b) the Contaminated Land (England) Regulations 2006 to provide for a new ground of appeal against a remediation notice. Part 2A of the Environmental Protection Act 1990 sets out a regime for the identification and remediation of contaminated land.
