    Oil palm investments are returning from Southeast Asia to West Africa, where the crop originated. As this interest intensifies, land conflicts are likely to become more prevalent. Our research shows that such disputes can treble the cost of cultivation and cause year-long delays. Despite this, many companies do not mitigate tenure risk because they lack the data and tools necessary to understand their risk exposure and take action.

It encourages communities to develop a negotiation strategy that incorporates advocacy at key points in order to strengthen their position.

    This paper examines whether national expropriation and land laws in 30 countries across Asia and Africa put Indigenous Peoples and local communities at risk of expropriation without compensation. In particular, this paper examines whether national laws ensure that communities are eligible for compensation and whether eligibility requirements effectively close the door on communities seeking compensation.

    In Nigeria, the recurring impoverishment and other negative socioeconomic impacts endured by landholders affected by expropriation are well-documented and call into question the Land Use Act’s (LUA) effectiveness in protecting local land rights. The World Bank’s Land Governance Assessment Framework found that, in Nigeria, “a large number of acquisitions occurs without prompt and adequate compensation, thus leaving those losing land worse off, with no mechanism for independent appeal even though the land is often not utilized for a public purpose”.

    Brazil has become an agricultural powerhouse, producing roughly 30 % of the world’s soy and 15 % of its beef by 2013 – yet historically much of that growth has come at the expense of its native ecosystems. Since 1985, pastures and croplands have replaced nearly 65 Mha of forests and savannas in the legal Amazon. A growing body of work suggests that this paradigm of horizontal expansion of agriculture over ecosystems is outdated and brings negative social and environmental outcomes.
