Legislation & PoliciesJurisprudenceNovember, 2016Africa, South AfricaThis is a judgement in the Land Claims Court which concerned the validity of land claims lodged under The Restitution of Land Rights Amendment Act 15 of 2014. This act was an amended version of the Restitution of Land rights Act 22 f 1994 which differed by extending the time frame for persons, descendants, or communities who were disposed of land after 1913 to lodge land claims. Previously the cut-off date under the 1994 to lodge claims was 31st December 1998. Under the 2014 Act, claims could up lodged from the passing of the act until 30 June 2019.

The main object of this participatory research was to test and refine land reform policy influencing the role of equity-share schemes as instruments of land and agrarian reform in South Africa.The papers presented were as follows:Land redistribution in Kwazulu-Natal: an analysis of Farmland transactions from 1997 until 2002 by Stuart Ferrer and Allan Semalulu.

Reports & ResearchMay, 2017South AfricaCensus surveys of land transactions show that 203,300 hectares of KwaZulu-Natal’s commercial farmland transferred to previously disadvantaged South Africans over the period 1997-2003. This represents 3.8 per cent of the farmland originally available for redistribution in 1994. The annual rate of land redistribution in the province fell from a peak of 1.06 per cent in 2002 to 0.41 per cent

Reports & ResearchFebruary, 2008South AfricaAt the first conference on land redistribution in South Africa, held in Johannesburg in 1993, Cyril Ramaphosa, the then secretary general of the ANC, noted that South Africa is not unique in its unequal land distribution but rather in the policy measures that have led to this situation (ANC, 1993). In contrast to most other countries with unequal land distribution, South Africa has a history of specific racial policies with clear implications for land distribution and ownership.

Suggests a new approach to land reform and rural development. ‘Rural territorial development’ is based on and encourages shared territorial identity (distinctive productive, historical, cultural and environmental features) amongst different stakeholders and social groupings. Builds on the fact that rural people’s livelihood strategies are complex and often mostly non-agricultural in nature.

While land reforms have long been motivated as a potential policy lever of rural growth and development, there is remarkably little evidence of the direct impacts of such reforms. In an effort to fill this lacunae, this paper examines South Africa's Land Redistribution for Agricultural Development (LRAD) program. We show that the implementation of this program operates as a natural experiment in which self-selected and administratively-filltered LRAD applicants receive land transfers at random points in time.
