Article 69 shall be amended to add the following wording: “Separation distance shall ensure non-proliferation of fires from forest species in forest areas (forest parks) to edifices and constructions located: (a) outside forest area (forest park); (b) within forest area (forest park); and (c) from forest species outside forest area (forest park) to edifices and constructions”.

The scope of creation of forest fire safety system shall be to prevent fires and ensure protection of the population and property in case of the outbreak of fire (Art. 5). Separation distance from the boundaries of housing land-use planning to forest area shall be no less than 50 m, and from the boundaries of housing land-use planning with one- and two-storey constructions to forest are shall be no less than 15 (Art. 69).

This Order establishes that state registration of the plots of forest land within state forest fund shall be carried out by state executive bodies responsible for keeping state forest register. State registration shall be carried out in the following cases: (a) allotment of the plots of forest land within state forest fund; and (b) renewal of lease contracts for the plots of forest land and renewal of free of charge forest management contracts in case of conformation thereof to the Forest Code.

This Order establishes that protection area shall be established with a view of protection of unique nature complexes and ecosystems of the protected area against unfavourable anthropogenic impact, conservation of old-age forests and biological diversity. Forest plots within the boundaries of protection area shall not be expropriated from landowners, land tenants, and servitude holders.

This Order establishes the modalities of reforestation with a view of restoration of deforested, destroyed and damaged forest areas. The scope of reforestation shall be restoration of forest plantations, conservation of biological diversity and conservation of environmental values of forests. Reforestation shall be performed in natural, artificial and combined (combination of natural and artificial reforestation) manner. Reforestation shall be performed on (a) forest plots allotted on lease for timber extraction; and (b) on other forest plots by state bodies and local government.

This Order establishes the list of requested technical documentation and the modalities of transfer of forest land to the category of unforested land for the purposes not related to forest and forest fund management. The aforesaid transfer can be carried out by initiative of legal and natural persons and requires authorization of the competent state forest institution by agreement with the organizations concerned. In the process of transfer shall be decided also allotment of the plots of land, conditions of expropriation thereof and payment therefore.

This Regional Law establishes that forestry taxes and lease payments shall be collected for: (a) allotment of standing timber; (b) procurement of edible and non-edible non-timber products; (c) agro-forestry; (d) use of forest fund (public forest) for hunting management; and (e) recreational use of forests, including tourism, sport and culture. Forestry taxes shall include taxes for forest land management.

The scope of this Regional Law shall be management, conservation, protection and reproduction of forests located on urban land. Urban forests shall be registered within the boundaries of urban areas and shall be destined for recreation of the population and conservation of favourable environment. Urban forest shall not be included in state forest fund, but shall be classified as public forest managed by regional administration. Urban forests shall be mapped and separated by boundaries form construction and residential areas.

This Regional Law regulates the issues of conservation, protection, management and reproduction of recreational forests in urban areas with a view of creation of favourable environment for the population. It shall also regulate the issue of afforestation and reforestation in urban areas. Regional executive bodies shall be responsible for education of the population related to management, keeping and reproduction of green plantations in urban areas.

This regional law establishes the modalities of land use planning of urban land based upon coordination of public and private interests and conservation of urban forests and forest parks. Regional administration shall be competent in the field of mapping and modification of urban land boundaries. In the process of projecting of urban land areas shall be taken into consideration recreational use of urban forests and forest parks and increase of forest cover.
