The Lao Land and Forest Allocation Policy (LFAP) was intended to provide clearer property rights for swidden farmers living in mountainous areas. These lands are legally defined as “State” forests but are under various forms of customary tenure. The policy involves demarcating village territorial boundaries, ecological zoning of lands within village territories, and finally allocating a limited number of individual land parcels to specific households for farming.

Land deals are frequently agreed in secret between governments and investors. This lack of transparency in the allocation of land fosters an environment where elite capture of natural assets becomes the norm, where human rights are routinely abused with impunity, where environmental destruction is ignored and where investment incentives are stacked against companies willing to adhere to ethical and legal principles.

    Afghanistan

In Afghanistan, insecurity over land and water rights hampers investments in food production and irrigation. In rural areas, customary tenure systems, partly based on religious law, are the most relevant but suffer from weak recognition and offer little protection to rights holders. The land policy reform is on-going but remains slow. Moreover, land administration capacity is weak and improvements mostly take place in urban areas. In this context, land disputes are common and often violent.

Land reform, land politics and resettlement in Laos have changed people’s land access and livelihoods. But these reforms have also transformed political subjectivity and landed property into matters for government to a degree hitherto unknown in Laos. The control over people, land and space has consolidated sovereignty in ways that make government an ineluctable part of people’s relation to land. This transforms agrarian relations. Three cases demonstrate how rural small holders’ access to land depends on the ways in which property and political subjects have been produced.

The recent political and economic liberalization in Burma/Myanmar, while indicative of some positive steps toward democratization after decades of authoritarian rule, has simultaneously increased foreign and domestic investments and geared the economy toward industrialization and large-scale agriculture.

Most of the land reforms of recent decades have followed an approach of “formalization and capitalization” of individual land titles (de Soto 2000). However, within the privatization agenda, benefits of unimproved land (such as land rents and value capture) are reaped privately by well-organized actors, whereas the costs of valorization (e.g., infrastructure) or opportunity costs of land use changes are shifted onto poorly organized groups. Consequences of capitalization and formalization include rent seeking and land grabbing.

At the turn of the 21st century, farmland was still considered an investment backwater by most of the financial sector. Although some insurance companies have had farmland holdings for years, most financial investors found farmland, and agricultural investment in general, unappealing compared to the much higher returns to be made in financial markets.
