    This Order, made under section 21 of the Agricultural Landlord and Tenant Act, declares the different classes of agricultural land of an agricultural holding set out in the Schedule to this Order to have the unimproved capital values specified therein. The land classified by this Order includes pastures, dairy land, rice lands, arable land and forest land.

    The Act provides that, notwithstanding anything contained in the Cook Islands Act 1915 or any other enactment or any order of any Court, no person shall be capable of leasing any land on any of the Motus Aitutaki set out in the Schedule to this Act. The prohibition shall not affect any interest in any land acquired prior to the commencement of this Act.

    This Act makes provision for the registration of alienators having the right to negotiate negotiation of alienation of land of custom owners and the registration of mortgages on alienated land. Furthermore the Act provides for various matters relative to negotiation of land and consequences of alienation. Notwithstanding the provisions of the Land Reform Act, Cap. 123, the Minister shall cause a register of alienators to be kept (sect. 2) and if the Minister is satisfied that an applicant under section 3 is an alienator he shall register him as such in the Register.

    The Minister may declare a port or any waters of Papua New Guinea and any land contiguous to such waters, to be a declared port for the purposes of this Act. The Papua New Guinea Harbours Board is established under section 3. The Board shall give effect to any direction given to it by the Minister on any matter of policy relating to the exercise or performance of its functions, duties or powers. The Board shall be responsible for the regulation, management, operation and control of declared ports.

    Section 19 of the Principal Act is amended in subsections (3) and (7) by inserting the following after the word "leases": "(1) (including sub-leases)". Section 109 (2) of the Principal Act is amended by inserting a comma at the end thereof and adding the following: "or he may sell the lease or sub-lease if the mortgaged land is a leasehold". Form No. 3 in Schedule LX of the Principal Act is amended by deleting paragraph (c) therefrom.
