    These Regulations provide generally with respect to development in the Seychelles. Development of any class specified in Schedule l to this Order is permitted and may be undertaken without the permission of the planning authority or the Minister. Such development shall be subject, however, to restrictions specified in the Schedule and the Minister may exclude certain development from this rule.

    This Act provides for the control and planning of development and for the acquisition and disposal of land for planning purposes under the Lands Acquisition Act. It establishes the Town and Country Planning Authority and defines its functions and powers. The Authority shall make a development plan based on the review of existing development in the Seychelles. The plan shall, among other things, designate land as land subject to compulsory acquisition. The Minister shall, by Order, provide for the grant of permission for the development of land as specified.

    These Regulations prescribe classes of use for purposes of the Town and Country Planning Act. Where a building or other land is used for a purpose of any class specified in the Schedule to these Regulations, the use of such building or other land for any other purpose of the same class shall not be deemed for the purposes of the Act to involve development of the land. Use classes include use as a wholesale warehouse or repository for the storage of food.

    This Act makes provision with respect to security of tenure. It provides for the protection of tenants by defining their rights and by allowing statutory tenants to register with the Registrar of Tenants' Rights appointed under this Act. The Registrar may require the Government to compulsory acquire premises under the Lands Acquisition Act for purposes of protection of rights of an applicant for registration. The Registrar may apply to the Registrar General for the subdivision of any land where the Minister certifies that the subdivision is desirable to give effect to this Act.

    This Act makes provision for the management and alienation of State land, for the appointment of forest rangers and for the protection of State lands and River Reserves.State land may be alienated by grant, sale or lease. State land may be sold by the President, with the exception of River Reserves belonging to the Republic. River Reserves are rivers and “rivulets” and adjacent areas listed in Schedule A to this Act. The Minister may, from time to time, add to or withdraw from the Schedule any watercourse.

    This Act makes provision with respect to small holdings i.e. any land or parcel of land with or without a dwelling house or other building erected or to be erected thereon not exceeding in all five acres in area let for agricultural purposes and of a specified maximum total value. The Act specifies the (contractual) rights of a tenant of a small holding including the use and enjoyment of all ground crops, plants, fruit trees or other trees. The Act also specifies rights of the landlord and provides with the resolution of disputes between the parties to any contract under this Act.

    This Act defines the right of access private islands of the Seychelles by a government officer and powers which may be exercised by Government officer. It also concerns the exercise of government functions by such officer. Any person shall have the right of access in case of an emergency to an island in private ownership. A government officer may, in exercise of his or her functions, among other things: inspect livestock and plantation on the island and fell any trees, lop branches and remove vegetation or brushwood on the island.

    This Act prohibits the abstraction of any sand or gravel or removal of abstracted sand or gravel without an abstraction licence to be by the Controller of Sands.

    This Act establishes the National Parks and Nature Conservancy Commission as a body corporate under section 3. The Commission may, with the approval of the Minister, by Order published in the Official Gazette, designate any area as a National Park, a Strict Natural Reserve, a Special Reserve, or an Area of Outstanding Natural Beauty. All these protected are defined in section 1. The Commission may enter into agreements with owners or other persons having an interest in an area which is designated as a protected area with the object of securing purposes of this Act.

    This Act establishes the National Monuments Board as a body corporate. The Board shall recommend to the Minister the declaration of any monument as a national monument and shall manage and preserve national monuments. If a monument is situated on land not belonging to the Government, a declaration shall be made in accordance with the procedure specified in this Act. Other provisions of this Act concern notification of discovery of any ancient monument or relic, excavation, exportation of any ancient monument or relic and offences.
