    This Order prescribes, in relation to England, the procedure for applications to the Secretary of State under section 38 of the Commons Act 2006 for consent to carry out restricted works on common land, and certain related types of applications. Restricted works” are: (a) works which have the effect of preventing or impeding access to or over any land to which this section applies; (b) works for the resurfacing of land. The procedures include the making representations in relation to applications.

    This Order prescribes, in relation to England only, exemptions to the prohibition in section 38(1) of the Commons Act 2006 on the carrying out, without the consent of the Secretary of State, of any restricted works on land to which that section applies. Exemptions include, subject to certain conditions, erecting of temporary fences for the purposes of (a) restricting the movement of animals which are grazing on the land, (b) allowing recovery of vegetation, and (c) nature conservation.

    These Regulations make miscellaneous changes to waste management legislation by amending the Environment Act 1995 (c.25) and the Waste Management Licensing Regulations 1994. Regulation 2 further amends the definition of "environmental licence”. Regulations 4 to 22 amend the 1994 Regulations. Regulation 4 broadens the scope of mobile plant prescriptions in regulation 12 of the 1994 Regulations.

    These Regulations amend the Waste Management Licensing Regulations (Northern Ireland) 2003 in Schedule 2 so as to provide for an exemption for the landspreading of sludges from on-site effluent treatment of waste from abattoirs and meat and fish processing plants referred to in the European Waste Catalogue.

    These Regulation amend, for England, Part 2 of the Environmental Protection Act 1990 so as to insert a new section (33ZA) on fixed penalty notices for contravention of section 33(1)(a) of the Act. The new section allows a waste collection authority in England to issue a fixed penalty notice for a contravention of section 33(1)(a) of the Act. Section 33(1)(a) prohibits a person from depositing controlled waste or extractive waste in or on any land unless in accordance with an environmental permit.

    These Regulation amend for Wales, Part 2 of the Environmental Protection Act 1990 so as to insert a new section (33ZA) on fixed penalty notices for contravention of section 33(1)(a) of the Act. The new section enable an authorised officer of a Welsh waste collection authority to issue a fixed penalty notice for contravention of that section in the area of the authority. Section 33(1)(a), subject to certain exemptions, prohibits the deposit of controlled waste or extractive waste in or on any land other than in accordance with an environmental permit.
