The Order sets regulations regarding the establishment, operation and supervision of geothermal systems with the purpose of preventing pollution of groundwater, soil and subsoil. The established systems shall operate in using soil as a heating sources. Applications for authorization to establish such systems is required and shall comply with criteria detailed in Appendix 1. The installation shall be provided with a pressure monitoring switch (1), an alarm (2) and a safety device in the event of a leak.

The Order partly amends Order No. 893. With regard to transfer of land: financial support may be granted for the management of transferred land to another natural or legal person by sale, lease, termination of lease or any similar type of transaction. With regard to acquisition: person assuming financial responsibility for the operation of one or more areas from people by purchase, lease, termination of lease or any similar type of acquisition (art. 2). Electronic applications shall be submitted to the Danish AgriFish Agency via their website.

The Order sets regulations with regard to surveying companies - which must, in addition to sole proprietorship - only be exercised by a surveyor company, operating in equity, private or corporate partnership. A surveyor company may only serve to drive the survey or the company. The latter, owned solely by practicing surveyors, may be the sole activity having to own shares in another surveyor company. The Minister shall lay down rules on the provision of corporate surveying, including rules on disposal of shares in the case of a shareholder’s death or cessation of exercise.

The Order sets rules on construction works or other installations and interventions on the environment which are listed under Appendices 1-2, and also applies to the extraction of mineral resources. The purpose of the Order is to implement environmental impact assessment (EIA) through the Danish Nature Agency and Environmental Protection Agency. The EIA shall identify, describe and evaluate a plant's direct and indirect effects on human beings, fauna and flora, soil, water, air, climate, landscape, material assets and cultural heritage, and the interaction between these factors.

The amendment of article 23, section 1 applies to the payment of subsidy which is based on documented expenses. Request for payment shall be submitted on a special form and enclose all supporting documents and proof of payment. Schedule for payment request is available through the Minister of City, Residential and Rural Areas’ website.

Request for payment shall be submitted on a special form and enclose all supporting documents and proof of payment. Funding shall be submitted to the AgriFish Agency no later than 3 weeks after the subsidy has been paid.

The Order sets rules applicable to the establishment and authorization of existing and new wells for groundwater extraction, mirroring, monitoring and dewatering, drilling with environmental and geotechnical purposes, drilling for vertical ground source heat pump wells, the discharge of water to the underground mining wells and other wells that are not covered by Act on Danish underground. Municipality authorities shall ensure approval of areas where these activities will take place.
