    In Mozambique, the law recognizes certain forms of occupation as constituting legal tenure and nationals can claim this recognition of their right to occupy and use land allocated through customary norms/practices. Local communities can also claim rights over land which they have customarily occupied, used, and managed. These rights are not prejudiced by their lack of titling or documentation and may be defended on the basis of oral testimony.

    This case study presents the unique example of pastoralist communities in Kenya who had traditionally been able to rely on their customary land governance systems to ensure their access to grazing land and to help them sustain their livelihoods in the face of drought. However, land laws that were passed by the colonial and post-colonial administrations in Kenya progressively replaced customary structures and practices with artificial formal/legal structures that bore no connection to the communities’ customs.

    This case study highlights the vulnerability of women in Fiaferana, who are disadvantaged, first, by their gender and indigenous heritage, and second, by their lack of tenure security in the midst of climate change. However, the women of Fiaferana have met these overlapping  challenges head-on through innovative and empowering strategies, including sustainable land use management.

LAND-at-scale is a seven-year programme (2019-2026), that aims to contribute to fair and just tenure security, access to land and natural resources for all.

    The Ministry of Agriculture in collaboration with the Responsible Governance of Investment in Land (RGIL) project conducted national Multi-Stakeholder Dialogue (MSD) under the theme “Responsible Agricultural Investment: A Pathway to Inclusive Sustainable Development”. It was held from 21 to 22 March 2023 in Addis Ababa, at Radisson Blu Hotel. The dialogue brought together ninety-one representatives of government officials, technical experts, academia, agricultural investors, the local community, civil society organizations (CSO), consultants, and the media.

    The race for the exploitation of natural resources has brought challenges of different natures, including land conflicts, mainly between investors and the local population. In some cases, the resolution of problems has been unfair due to the lack of legal knowledge and representation to help the vulnerable population. It is in this context that the paralegal figure was established, endowed with solid knowledge to voluntarily provide basic legal support to community members.

    The second Multi-Stakeholders Dialogue Forum (MSD 02) was held from 29 to 31 March 2022 in Bahir Dar city, the capital of the Amhara region. The MSD Forum brought together 115 representatives of government officials, technical experts, investors, local community representatives, development partners, and the media in order to find solutions to the various challenges in the governance of largescale agricultural investments in Ethiopia. The three-days MSD meeting included presentations, group work and field visits.
