    The Decree establishes the acceptability criteria to be applied to the landfill of waste in accordance with the categories specified by article 4 of Legislative Decree No. 36 of 13 January 2003. Article 2 concerns installations for inert waste; article 3 concerns installations for non hazardous waste; article 4 concerns installations for hazardous waste. Article 5 sets out acceptability crietria for underground landfill of waste.

    The present Decree establishes guidelines relating to the implementation of new systems of Environmental Impact Assessment, which are intended for preventing and reducing environmental pollution. The guidelines deal particularly with noise pollution, atmospheric pollution and soil and water pollution.

    Based on the assessment of the present environmental degradation caused by the inadequacy of the purification systems, and of the data collected through an official census on the water pollution of the country, the special plan aims at the achievement of the following objectives: (a) identification and implementation of urgent interventions necessary for the protection and sanitation of waters and catchment basins; (b) completion of works already financed; (c) putting into operation of completed works. The Decree establishes criteria and modalities for the elaboration of the plan.

    It is hereby apporved and laid down (Annex 1) the questionnaire concerning the effective implementation of Legislative Decree No. 372 of 1999, in compliance with article 16 (3) of Directive 96/61/EC and particularly as regards the duty to submit the information concerning the emission limit values applicable to the installations listed out in Annex 1 to that Directive.

    In view of the fact that a good knowledge of the biochemical characteristics of soil is necessary in order to arrange and implement a sound national policy for programming the use of soil and waste water for irrigation purposes, this Decree approves the official methods to be applied in the biochemical analysis of soil.

    Article 4 of Directive 91/676/EEC requires Member States to establish a code or codes of good agricultural practice with the aim of providing for all waters a general level of protection against pollution. The present Decree, in implementation of such provision, lays down the code of good agricultural practice. This code takes into account solely the matters connected with the use of nitrogen in agriculture. The Regions shall elaborate special programmes on farmers’ training and education with a view to promoting the effective implementation of the code.

    This Decree aims at encouraging and at the same time regulating the use of sewage sludge in agriculture, in order to prevent harmful effects on soil, vegetation, animals and human beings. The sewage sludge shall be used as fertilizer and soil improver only after proper treatment and under the conditions established by article 3, regarding the composition, the concentration of heavy metals and other standards. Article 4 establishes the cases in which the use of sludge in agriculture is prohibited.

    By way of implementation of Directive 96/61/EC, this Legislative Decree aims at the integrated prevention and control of pollution which arises from the activities specified in Annex I. There are established particular measures intended to prevent and reduce emissions into the air, water and land, comprising general principles in matter of waste management. Furthermore, the Legislative Decree regulates the issue and renewal of the environmental integrated authorization which is required for the installations mentioned in Annex I.

    The purpose of this Legislative Decree is to achieve integrated prevention and control of pollution arising from the activities listed in Annex I, in order to reach a high level of protection of the environment taken as a whole. It lays down measures aimed at reducing and preventing emissions in the air, water and land from said activities ( which are, among others, energy industrial activities, production and processing of metals, waste management ). An authorization is compulsory to operate all or part of installations listed in Annex I.

    This Legislative Decree aims at achieving the objectives of article 2 of Legislative Decree No. 22 of 5 February 1997. To this end, it establishes technical requirements applicable to landfills of waste, procedures and guidance with a view to preventing and reducing negative effects on the environment and on the global environment (including greenhouse effect) as well as those risks to human health that might result from landfilling of waste. Particular attention is paid to the prevention of the pollution of surface water, groundwater, air and soil.
