    An Act to Provide for a Land Commission in Rotuma, the registration and dealing with and transmission of land and matters incidental thereto.

    This Act provides for various aspects relative to dealings in land in Rotuma and provides for the appointment of the Rotuma Lands Commission. The Commission shall ascertain (traditional) land rights, resolve disputes relative to land rights, demarcate land and register land rights (sect. 4). All land found by the Commission to be un-owned shall vest in the Crown in trust for the Rotuman people, but shall not be considered to be Crown land. All moneys derived from such un-owned land shall be paid into the Rotuman Development Fund and be used for the purposes of that Fund.

    These Regulations shall apply to all town planning areas constituted under the Act, excepting those areas in respect of which a scheme has been approved under section 24 of the Act. Subject to the subsequent provisions of these Regulations, development of any class specified in the First and Second Schedules is permitted by these Regulations and may be undertaken upon land to which these Regulations apply, without the express permission of the local authority under section 6 of the Act.

    A scheme submitted to the Director for provisional approval shall be accompanied by basic survey maps and an explanatory report in accordance with the requirements specified by the Director. Such scheme shall include all information set out in these Regulations (reg. 3). When the Director has provisionally or finally approved a scheme in accordance with the Act, the local authority shall publicly notify the scheme as provided for in regulation 4 and the Schedule.     This Act provides for a wide variety of matters relating to land, land use rights, transfer of land, etc. All land subject to the provisions of the Land (Transfer and Registration) Ordinance and every estate or interest therein and all instruments and dealings affecting any such land, estate or interest shall from the commencement of this Act be deemed to be subject to the provisions of this Act.

    This Act shall apply to any agreement, regardless of its form, which is intended to give rights in personal property, including houses on land not owned individually or entirely by the party or parties purporting to give an interest in the house, as security for the performance of any obligation. Such Agreements include, among others, pledges, conditional sales agreements, chattel mortgages, and leases under which ownership of personal property is to pass upon completion of the terms of the lease.

    The provisions of this Act shall apply to any part or whole of any such area or areas as the Minister may, from time to time, by Order in the Gazette define and shall apply to all lands described therein except those listed in section 2. No land shall be subdivided without the approval of the Director of Town and Country Planning except in the circumstances listed in section 4. Application for approval by the Director must be made in accordance with section. Local authorities shall consider the application and make recommendations to the Director (sect. 7).

    The object of this Act is to provide for a system based on custom to resolve disputes about customary land. This Act provides for the establishment of land tribunals to resolve disputes about customary land and prescribes the procedures to be followed by those land tribunals in resolving such disputes and rules of appeal for parties who are dissatisfied with decisions of land tribunals. Part 2 sets out how a village land tribunal is to resolve a customary land dispute. A village land tribunal can be a single or joint village land tribunal depending on where the land in dispute is situated.
