The present Decree establishes guidelines relating to the implementation of new systems of Environmental Impact Assessment, which are intended for preventing and reducing environmental pollution. The guidelines deal particularly with noise pollution, atmospheric pollution and soil and water pollution.

All regional interventions aimed at soil conservation, protection of environmental balance and nature preservation shall be implemented in conformity with the general plan referred to in article 1 of Regional Act No. 36 of 16 August 1974. The Regional Counsel for Agriculture and Forestry shall be in charge of the drafting of a general plan concerning the interventions to be undertaken in the field of soil conservation, protection of the environmental balance in forests as well as nature preservation. The Act describes the approval procedure, which involves Mountain Communities. Particular provisions deal with expropriation of lands to be included in the forest domain and hence subjected to the interventions envisaged in the plan.

The Regional Territorial Environmental Plan shall be composed of the various Territorial Environmental Plans of “Large Areas” (Chapter II), which shall cover elements of a naturalistic interest (biological and physical) as well as elements regarding agricultural production. By enacting this Decree the Regional Environmental Counsel has established the plan on hydrogeological rearrangement in the Sicilian Region. The Plan, which is attached to the Decree, defines the areas under hydrogeological risk. Only the interventions mentioned in article 2 shall be allowed, according to the various risk levels. The Plan is composed of a general report, a report concerning the territory and hydrographic basins, and cartographies.

In implementation of the Alpine Convention of 1991, the Signatory Parties have concluded this Protocol to promote their cooperation in matter of territorial planning and sustainable development. The Protocol is divided into five Chapters: (I) General Provisions; (II) Specific Measures; (III) Research, Education and Information; (IV) Enforcement, Control and Assessment; (V) Final Provisions. The Parties undertake to adopt territorial planning and sustainable development policies by harmonizing both economic interests and environmental protection requirements (art. 3).

This Decree Law represents the basic legal framework in matter of forestry. Since it was enacted in 1923, it must be coordinated with the Constitution, which entrusts particular legislative and administrative competences to the Regions in matter of forestry as well (art. 117). The Decree consists of seven Titles. Title I makes provision for the protection of the public interests. To this end, certain restrictions shall be applied to private lands, so as to guarantee the public safety and protect the water regime.

This Decree lays down provisions for implementing Provincial Act No. 21 of 21 October 1996 relative to the forestry sector. The Decree is divided into three Titles and contains two Annexes. Title I regulates the hydrogeological and forest bonds referred to in article 3 of Provincial Act No. 21 of 1996. Article 2 concerns its removal under certain circumstances. Title II lays down particular provisions for bound lands. Part I of Title II regulates the transformation of forests. Article 4 gives the definition of forest.
