This Act provides for sale and lease of land, and any estate or interest therein, which is the subject of a settlement. “Settlement” signifies any act, deed, agreement, will or other instrument under or by virtue of which any land or any estate or interest in land stands limited to or in trust for any persons by way of succession. Settled estates may be sold or given in lease under authority of the High Court or by a tenant for life.

The Minister may, by notice in the Gazette, declare any monument or antiquity to be a protected monument or antiquity within the meaning of this Act and shall establish an Authority to manage and supervise the ancient moments or antiquity. Land shall be aquired for a public purpose within the meaning of the Land Acquisition Act.

This Act amends the Land Tenure Act of 1992 with respect to among other things: definitions of "ownership", "Department" and "Director" (sect. 2); administration of public land (sect. 3); measures regarding violation or breach of the terms and conditions of a lease of public land. The Act also adds new sections (6A, 6B and 6C) concerning measures against misuse of land and a new section 42A which protects rights of occupiers of land under agricultural grants granted pursuant to section 41 of the principal Act in respect to, among other things, cultivation.

Mortgaged land may be leased by mortgagee or mortgagor for agricultural or mining purposes. As for mortgages the Act specifies procedures for execution.

Where the damage amounts to total destruction, the compensation shall be calculated at the rates set out in the Schedule. If the damage is partial, the compensation shall be calculated on that proportion of the amount for total destruction directly attributable to the damage as may be determined by assessors appointed by the parties within four days of the occurrence of the damage.

This Act shall not apply to any African who is in occupation of land on an estate by virtue of a valid lease or tenancy agreement for a period of not less than two years.
