The report documents how affected communities have lost their livelihoods because of land grabbing by national and international business corporations. The Land Law of 2001 was a landmark statute intended to strengthen and protect the rights of ordinary Cambodian landholders. A land titling programme (LMAP) was initiated soon afterwards, with extensive World Bank and donor support. The land occupied by the community of Boeung Kak, in the heart of the capital was excluded from this process, despite evidence of prior residence going back decades. Instead it was classifi ed as having “unknown status” by the LMAP, as “state land” by default, and as a “development zone” by authorities.

    Vietnam

The transition to a market economy has sparked Vietnam's unprecedented urbanization and industrialization. In order to accommodate the spiraling land demand triggered by urban and economic growth, the Vietnamese government has been using the mechanism of compulsory acquisition at an astounding scale to convert massive amount of agricultural land to urban land for non-agricultural uses. A large number of the country's poorest, most vulnerable citizens have been forced out of their land to make way for development projects, yet, they are also the group that have least benefited from them.

Land is the repository of memory and keeps traces of the past in the absence of a strong written tradition. It is perceived as an open book from which anyone can read and learn about local history: place names, old roads, legends and stories attached to places. For local people, bulldozing the landscape is seen as erasing their history, and disturbing social organisations and traditions. In Cambodia--as in many other countries--land is an extremely important economic resource and asset. Land is livelihood.

In this publication, the issue of tenure security is addressed and assessed in several countries where government, civil society, the private sector and development cooperation initiatives have been implemented for decades. The selected case studies from fifteen countries in Africa, Asia and Latin America ensure not only a eographic balance but they also represent countries with different socio-economic and land-related histories and that have followed different pathways. The studies’ key findings underline the still precarious state of tenure security in many countries.
