    En este artículo presentamos una reflexión analítica sobre los principales aspectos y oportunidades favorables que pueden surgir para mujeres de menores ingresos o comunidades marginales de Colombia a partir del pronunciamiento de la ONU A/64/L.63/Rev.1, del 26 de julio de 2010,1 que “declara el derecho al agua potable y el saneamiento como un derecho humano esencial para el pleno disfrute de la vida y de todos los derechos humanos”.

    Se analiza la forma en que se expresa y recrea la discriminación de género en los procesos de adopciónde decisiones sobre la asignación de derechos de agua en el Distrito de Riego 101 Cuxtepeques, localizadoen la cuenca del río Grijalva, en Chiapas, al sur de México. Se destaca la relevante participación de lasmujeres campesinas propietarias de tierra, tanto en la producción agropecuaria y en las labores de riego,como en la subsistencia de sus hogares en su calidad de jefas de familia.

    El objetivo de este artículo es hacer una propuesta metodológica para incorporar la perspectiva de género en las herramientas de planeación de la Ley de Víctimas y Restitución de Tierras a nivel territorial. Las medidas de reparación integral a favor de las mujeres deben reconocer que las violencias producto del conflicto superan el episodio mismo y agudizan las brechas de inequidad y goce efectivo de derechos entre hombres y mujeres.

    Paper discusses Zambia’s dual land tenure system, the ways in which gender issues have been incorporated in legal and policy documents, and the extent to which this has been reflected in practice. It also examines the role of donors in legal and policy processes and donor support to civil society in relation to women’s land rights. Gender and land policies provide for the allocation of land to women, but have little impact on the ground. Customary law is on the whole discriminatory against women, in particular with regard to land ownership.
