    These Regulations revoke the European Communities (Control of Major Accident Hazards Involving Dangerous Substances) Regulations 2006 as amended by the European Union (Control of Major Accident Hazards Involving Dangerous Substances) (Amendment) Regulations 2013, as part of the transposition of Directive 2012/18/EU “of the European Parliament and of the Council on the control of major-accident hazards involving dangerous substances, amending and subsequently repealing Council Directive 96/82/EC” into Irish law.

    These Regulations amend the Planning (Hazardous Substances) Regulations (Northern Ireland) 1993 to implement Article 30 of Directive 2012/18/EU of the European Parliament and of the Council on the control of major-accident hazards involving dangerous substances, which amends Council Directive 96/82/EC on the control of major-accident hazards involving dangerous substances. They insert “heavy fuel oils” to the list of hazardous substances and controlled quantities in Schedule 1 and concern exceptions for existing hazardous substances consents.

    This Order, made bu the Department of the Environment in exercise of the powers conferred by section 32 of the Planning Act (Northern Ireland) 2011, grants planning permission in respect of certain development which is necessary for the purposes of housing poultry and other captive birds to protect them from avian influenza. The Order applies to land within a controlled zone, H5N1 controlled zone, wild bird control area or wild bird monitoring area declared by the Department of Agriculture and Rural Development and to any identified premises.

    These Regulations prescribe the bodies the Department must consult for the purposes of section 104(5)(b) of the Planning Act (Northern Ireland) 2011 before making a conservation area designation. These bodies are, for the purposes of these Regulations, the Department of the Environment, the Department for Regional Development and any water or sewerage undertaker. They also prescribe bodies that must be consulted before varying or cancelling a conservation area designation (the council concerned, the Department for Regional Development and any water or sewerage undertaker).

    These Regulations amend regulation 2 of the Control of Major Accident Hazards Regulations (Northern Ireland) 2000 so as to give effect to Article 30 of Directive 2012/18/EU of the European Parliament and of the Council on the control of major accident hazards involving dangerous substances. Article 30 concerns classification of heavy fuel oils.     This Order amends various provisions and Schedule 1 of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 in relation with changes the classes of development which are permitted and in relation with specified construction works. Development is not permitted in a conservation area, national scenic area, a historic garden or designed landscape, a National Park or a World Heritage Site.
