    Land in Cameroon is under growing pressure for many reasons — powerful commercial interests, changing climate conditions and shifting demographic flows including mass migration and increasing population density. The rights of rural communities and indigenous people to access and use land for farming and grazing have been eroded — primarily due to failure to recognise customary land tenure rights, land use conflicts and lack of effective local governance. The country’s land legislation is indeed outdated and not compatible with customary law and local realities.

    The report explores the evictions of pastoralists and other conflicts over pastoralists’ land in Tanzania, with focus on the past decade. 


    Although most of these evictions and land based conflicts have been documented, the associated human and legal rights violations have increasingly lead to concern amongst civil society. A study was therefore commissioned to collate the available information as well as to visit affected pastoralist communities to assess the current situation faced by pastoralists in the country.

    The Predicaments of Pastoralists Evicted to Rufiji District

    This fact finding mission had been organised to investigate the challenges facing pastoralists in Rufiji District, the challenges which have been defined as the source of conflict in this district. Although pastoralists had arrived in Rufiji since 1990’s but they officially went there and other places in Coastal and in Lindi Regions after they had been evicted from Ihefu and Kilosa in 2006-9. The Government, through their operation, announced to prepare areas for pastoralists and also to set all necessary and potential services for them to survive In Lindi, Ruvuma and Pwani Regions.

    This paper considers possible answers to these difficult questions by focusing on two issues: the evolution of legal norms in response to both endogenous and exogenous changes, and the role that African customary law and indigenous dispute resolution has played in promoting coordination and cooperation among group members, thereby reducing violent conflict. This paper explores legislative actions taken by the Nigerian government that impede the continued evolution of these relatively elastic customary legal norms.

    The current approach to peacebuilding by the international community is to focus on the priorities thought to be important to recovery, but this occurs in a largely non-integrated way. With these different endeavors largely isolated from each other in planning, analysis, implementation, and measures for success, little is known about how they interact and whether or not the aggregate effect contributes to, or detracts from durable peace. This is especially important for priorities which in some way interact with each other on the ground among a recipient population.
