    Preamble: "Hong Kong has been part of the territory of China since ancient times; it was occupied by Britain after the Opium War in 1840.  On 19 December 1984, the Chinese and British Governments signed the Joint Declaration on the Question of Hong Kong, affirming that the Government of the People's Republic of China will resume the exercise of sovereignty over Hong Kong with effect from 1 July 1997, thus fulfilling the long-cherished common aspiration of the Chinese people for the recovery of Hong Kong.

    "This Law determines the legal regime of the state-owned property, the legal basis of management of the state-owned property, including the property assigned to the state legal entities and the stocks and shares owned by the state in the authorized capital of legal entities, the legal basis of acquisition of rights and termination of the rights to the state-owned property and is aimed at providing effective implementation by the state of the rights of the owner and owner of other rights to the state-owned property."

Par ailleurs, en ce qui concerne toute terre non immatriculée (vacante et sans maître, à moins que ne soit rapportée la preuve du contraire), elle prévoit la constatation et régime des droits coutumiers par une commission dont la composition est fixée par décret.
