Section 5 concerns easements on banks of waterways.

The present Land Code regulates land relations and is aimed at the creation of conditions for rational use and protection of land, reproduction of soil fertility, conservation and improvement of environment and equal development of all forms of land tenure. This Decree establishes that the forms of Certificate of landownership can be used provisionally, till the issues of the state legal form, as a document for lifelong ownership valid for inheritance and limitless (permanent) land lease. This Decree validates the forms of Certificate of landownership, Contract of tenancy for agricultural land, Contract of temporal leasehold of agricultural land. The President, for the purpose of promoting effectual land tenure, decrees that the priorities of purchase of the plots of land (or the shares of them), on which are situated previously privatized edifices, have physical and juridical persons that own these edifices. The Decree establishes that the property put on sale regards plots of land (or the shares of them) that had been previously conceded to a tenant or a leaseholder on condition of permanent (limitless) tenure, lifelong ownership with the right of inheritance or of limited tenure, including rent.

Le système de la tenure traditionnelle du sol est aboli. Les terres qui ont appartenu à l'Etat, en vertu des dispositions de la loi n 60.139 du 2 Août 1960, demeurent domaniales.

Land legislation shall be based on the principles set out in article 3. In accordance with the Constitution of the Kyrgyz Republic, land may be the state, communal, private or other forms of ownership (art. 4). Article 4 also defines state lands and communal ownership. Article 5 concerns rights of foreigners to use land. Transactions with rights to a land plot shall be subject to state registration and shall not require notarization, except for the cases provided by law (art. 9). Article 10 defines the Land Fund of the Kyrgyz Republic.

Land reform is carried out so as to provide for the redistribution of the land in order to create the necessary conditions for equal in rights development of various forms of economy on the land, the formation of versatile economy, for the determination of the rates of the fees for land, and the rational use and protection of the lands at the territory of the Republic of Kyrgyzstan.

A law that regulates land-use planning and rational exploitation of land. Land is property of the Government of the Republic of Guinea-Bissau, its exploitation is allowed only under concession or authorization granted by the Government. Agricultural land exploitation areas shall not exceed 300 hectars, but the Council of Ministers may authorize land-use concessions to cooperatives and national or foreign companies for areas not exceeding 1500 hectars.
