This General Notice, made under section 6 of the Deeds Registration Act, exempts all Licences for the occupation of land issued by the Minister under the powers conferred upon him or her by section 5 of the Land Act in connection with Agricultural Settlement or Re-Settlement in any part of Malawi, from the requirement of registration as provided for in the Deeds Registration Act.

The Regulations also specify particulars that shall be included in the registers.

These Regulations set out the form of an application under section 7(3) of the Cadastral Survey Act 2011. Such application shall be accompanied by the appropriate fee specified in the Second Schedule. Section 7 stipulates that any interested person may apply for the assignment of a Parcel Identification Number (PIN) in respect of any plot of land or unit to be assigned by the Chief Surveyor.

These Regulations amend the Regulations made under the Sectional Titles Act, 1986 with respect to a wide variety of matters including: sectional mortgage bonds; forms for certificates and other documents issued or made under the Act; management rules set out in Annexure 8; and registration of documents. They also insert new provisions on: replacement of a schedule for a lost or destroyed schedule of servitudes and conditions referred to in section 11(3)(b) of the Act; and replacement of documentation referred to in section 25(2) of the Act.

These Rules concern a request under section 146 of the Registered Land Ordinance by an aggrieved party to the Registrar to state a case for the opinion of the Supreme Court and an appeal under section 147 of the Ordinance against a decision of the Registrar. The Rules prescribe forms of request or appeal and lay down some procedural requirements.
