    A Decree to provide for fees for the use of State land by private parties and land registration. A user of land that is entrusted the state to him for purpose of agricultural and forestry production, breeding of sea products, and producing salt, shall pay land using fees when using the land for other than allowed purposes. Organizations, families, individuals shall pay cadastral fees in the following cases: granting the land use right certificate; certifying the registration of the change on land; extracting the cadastral file.

    A Decree to provide for ownership, allotment, use, registration of residential land and houses by citizens of Viet Nam and leasehold by foreigners, and in relation to this the assignment of title, the issue of certificates, settlement of disputes and other matters. The State recognises and protects the lawful title to residential houses and lawful right to the use of residential land. All residential houses and land must be registered. The lawful owners are issued the certificate of residential house title and residential land use right.

    Religious establishment (not defined) shall be assigned by the State land areas that they are currently using without any "readjustment thereof". Land includes agricultural and forestry land. Local authorities shall grant land use right certificates for the land on which religious buildings are constructed. Establishments receiving such certificates shall appoint legal representatives who shall be held responsible versus the State for the use of the land allocated to their organizations. Existing land disputes shall be settled prior to the granting of the certificate.

    These guidelines are issued by the General Department for Land Management concerning utilization of bare land, degraded hills, forests, alluvial flats and water bodies. The approval of land use projects will be based on the economic-technical viability of the project with the objectives of good land management and sustainable land use. The project implementing agency shall classify the land depending on the objectives of the project and the land available. Land should be used in accordance with plans made, the land should be protected and the fertility of the soil improved.
